To all,
After further research and discussing this with the owner, we have decided it is not worth it to pursue the
easement vacation at this time. The cost just to put the application together, getting concurrences, etc, is a
significant cost and a'small deterent. However, the biggest deterent is the faclthatthere are underground phone
lines in the southerly ,,13' x 100' portion of the pue lhat would need to be relocated. This area was the biggest
reason for the pue vacation as it would free up the biggest area for additional develepment. However, since there
is no immediete need to vacate we have decided to postpone the vacation until such time that there is a need
such as a building o'r something that could not be done without the vacation. The owner is keeping all of the
responses in a file inicase the need arises in the future to vacate any portions of these pues. Thanks for you

Thanks Mike, the application form for PUE Vacation is posted on the City's Land Use Applications webpage.
The City recently <l.dopted changes to the Development Code allowing for easement vacations to be done as a
Type II Director's Decision instead of a Public Hearing before City Council, so this should streamline the
process. If you have any questions please let me know.

To all,
In conjunction with'the development of the subject property, I would like to propse the vacation of some PUE's,
The proposed vacation is shown on the attached map (easement vacation. pdt). The site is to be developed for
Enterprise Rent A Car at 4396 Main Street, under City file No. DRC 2007 -00083 and includes the dedication of
a 7' PUE along Main Street and 44th Street as proposed in the attached easement (see attached 3873e01
sub.pdf also show~ on the easement vacation plan). While the new PUE dedication is in process I would like to
start the process to vacate these other PUES, should it be determined that there are no public utilities located in
them. I have attached the plats where the pues were created and highlighted the subject property as well as
the PUEs. The subject property is Lots 1, 2, & 3, Block 1, of the Plat of Hollyson and the easterly 60.72 feet of
Lot 15, Fisher's Plat (tax lot 100, see attached Assessor's Map 17023231). A 6 foot PUE was created along
the west boundary of lots 1, 2, & 3 of Hollyson, of which we would like to vacate at least the southerly 100 feet
adjacent to Lot15 of Fisher's plat. We would also like to vacate the remaining portion of the 6' PUE along the
northerly 115 feet of the site if possible, The resulting minimum PUE vacation would be a 13' by 100' vacation
as shown, with an ""dditional 6' x 115' vacation if possible. Prior to going any further with the proposal I would
like to make sure there are no public utilities located within the PUEs. Please let me know if you have any
questions or concerns.
