UNDERGROUND EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that the undersigned, DEAN HELFRicH AND GAYLE
D. HELFRICH, CO-TRUSTEES OF THE HELFRICH FAMILY REVOCABLE LIVING TRUST, for
a good and valuable consideration, of the payment of the sum of $0.00, the receipt whereof is
hereby acknowledged, does hereby grant unto the City' of Springfield, a municipal
corporation, acting by and through its SPRINGFIELD UTILITY BOARD, and unto its successors
and assigns, the right to enter upon the lands of the undersigned situated in the City of
Springfield, State of Oregon, and more particularly described as follows:

Beginning at the Initial point for the 2nd addition to Phyllis Park as platted and recorded in
Book 61, Page 18, Lane County, Oregon Plat Records; thence along the NortJiern plat

boundary of 2nd addition to Phyllis Park, North 89054'01" East 116.40 feet, to a point on.
the Eastern right-of-way line of 20th Avenue; thence leaving said plat boundary, along said
right-of-way line, North 19006'00" West 35.34 feet; thence along the arc of a 46.00 foot
radius curve to the left (the chord of said curve bears North 53001'42" West55.33 feet) a
distance of 59.37 feet; thence leaving said right-of-way line North 190.12 f~et; thence East
154.15 feet; thence North 00006'12" West 19.42 feet; thence South 89057'49" East 326.46
feet; thence South 00002'11" West275.81 feet the Point of Beginning all in Lane County,
Oregon .
This property is also known as Tax Map 17-03-24; Tax Lot 500
A 10' easement along the entire South and East property line to place, construct, operate,
repair, maintain, relocate, and replace therein an underground electric distribution line,
including vaults, transformers and other necessary facilities, to remove ana replace fences
and lawns to the extent necessary to construct, maintain, and protect said lines. No part of
any building or permanent structure will be placed upon this easement, oth~r than asphalt
pavements, curhs, sidewalks, and driveway aprons.' This easement does. not restrict the
installation of Qwest Communications and Comcast facilities provided installations meet.
