Subject: L TO Agreement for Gateway Mall Station
Len: I am reviewing the pre-submittal package for a site plan modification that proposes to relocate the Gateway
Mall L TD station to the edge of Gateway Street north of the Umpqua Bank. A portion of the station is proposed
within public right-of-way that is to be dedicated from the mall property. The applicant states they will have an
agreement with the mall owner for maintenance and operation of the transit station. The applicant's project
narrative states the details of the agreement have not been worked out, but are not relevant to the site plan
review and therefore should be of no concern to the City. I would question this position and ,suggest the
agreement might very well be a tripartite agreement between the mall, L TD and the City, recognizing the facility is
proposed to straddle private property and public right-of-way. What are your thoughts on this issue so we can
provide direction to the applicant? Thanks
