OR 97477 PHONE (541)726-3753 FAX (541)726-3689 www.ci.springfield.or.us CASE NUMBER: LRP2009-00004 APPLICANT: City of Springfield NATURE OF THE APPLICATION: Proposal to annex 11.34 acres of public street right-of-way into the City of Springfield. Portions of Martin Luther King, Jr. Parkway, Game Fann Road, and Deadmond Ferry Road rights-of-way are proposed for annexation. AUTHORIZED USES: The subject rights-of-way are developed as urban streets. Upon annexation, the subject rights- of-way will be absorbed into the adjacent zoning district, which includes Low Density Residential (LDR), Medium Density Residential (MDR), Community Commercial (CC), and Mixed Use Commercial (MUC). The annexed rights-of- way are intended to remain as public streets. APPLICABLE CRITERIA: The City Council shall approve, modi/y or deny any annexation application based upon the following approval criteria: A. The affected territory proposed to be annexed is within the City's urban growth boundary and is I. Contiguous to the city limits or 2. Separated from the City only by a public right of way or a stream lake or other body of water; B. The proposed annexation is consistent with applicable policies in the Metro Plan and in any applicable refinement plans or Plan Districts; C. The proposed annexation will result in a boundary in which the minimum level of key urban facilities and services as defined in the Metro Plan can be provided in an orderly efficient and timely manner; and D. Where applicable fiscal impacts to the City have been mitigated through an Annexation Agreement or other mechanism approved by the City Council (SDC 5.7-140). SUBJECT PROPERTY LOCATION: Portions of Martin Luther King, Jr. Parkway right-of-way within Maps 17-03- 22, 17-03-22-12, 17-03-22-41, 17-03-22-44, and 17-03-27-11; portions of Game Fann Road right-of-way within Maps 17- 03-15-04 and 17-03-22-12; and portions of Deadmond Ferry Road right-of-way within Map 17-03-15-04. DATE, TIME, AND LOCATION OF THE HEARING: The Springfield City Council will hear all testimony for and against the proposal on July 6, 2009, at 7:00 p.m. at 225 Fifth Street in Springfield City Hall Council Chambers. ADDITIONAL INFORMATION: The application, all documents and evidence submitted by or on behalf ofthe applicant and the application criteria are available for inspection at City Hall at no cost and will be provided at a reasonable cost.
