HomeMy WebLinkAboutResolution 07-24 06/04/2007 RESOLUTIONNO 07-24 A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY I TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY I LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE ANNEXATION WHEREAS, the City received alrequest to annex approximately 15,888 square feet (0.36 acres) into the City of Springfield on April 18, ~007, said territory being described as follows: I Township 18 South, Range 2 West, Section 6, Map 11, Tax Lot 600 (commonly known as 4080 North Street, Springfield) as gener~lly depicted in Exhibit A and more particularly described as LOT 3, BLOCK 1, H.F. FRANKL~ ADDITION, AS PL~TTED AND RECORDED IN BOOK 14, PAGE 31, LANE COUNTY OREGON PLAT RECORDS, IN LANE COUNTY, OREGON. WHEREAS, the territory propos1ed to be annexed is within the Eugene-Springfield Urban Growth BoundaIy, and is adjacent to the ICily Limits; aod, WHEREAS, the Common Council is authorized by ORS 199.490(2)(a)(B) to initiate annexation upon receiving consent in writing frott a majority of the electors registered in the territory proposed to be annexed and written consent frorb owners of more than half the land in the territory proposed to be annexed; and, WHEREAS, one hundred percent of the property owners of the territory signed a consent to annex (Exhibit B); and, WHEREAS, there are no registered electors residing within the territory proposed for annexation (Exhibit C); and, WHEREAS, the City Council is authorized by Springfield Development Code 6.070, ORS 222.111 and other applicable Oregon Revised Statutes to initiate allllexation when the territory in the annexation proposal can be provided with the minimJm key level of urban facilities and services in an orderly and efficient manner as defined in the Eugene:-Springfield Metro Area General Plan Policy 8, Page II-B-4, and where there will be a logical area and time within which to deliver urban services and facilities; and, WHEREAS, minimum level Of~ey urban services and facilities are defined in the Eugene-Springfield Metro Area General Plan, Page f-3 as sanitary sewer service, stormwater service, solid waste management, water service, fire and emergency medical services, police protection, city-wide parks and recreation programs, electric service, land Lise controls, communication facilities and services, and public schools on a district-wide basis; and, WHEREAS, the territory proposed to be annexed can be immediately provided with a minimum level of key urban facilities and services, I with the exception of City storm water and sanitary sewer services which are available along the public street frontages of the property; and, I . WHEREAS provision of City st~rmwater and sanitary sewer services can be provided in an orderly and efficient manner and does not require an Annexation Agreement; I . I NOW THEREFORE BASED ON THE FOREGOING RECITALS, THE COMMON COUNCIL OF THE I CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: I Section 1: The Common Council of the City of Springfield does hereby recommend approval of the annexation of the subject territorY to the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territbry being described as follows: I Township 18 South, Range 2 West, Section 6, Map 11, Tax Lot 600 (commonly known as 4080 North Street, Springfield) as genedlly depicted on Exhibit A and more particularly described as LOT 3, BLOCK 1, H.F. FRANKL~ ADDITION, AS PLATTED AND RECORDED IN BOOK 14, PAGE 31, LANE COUNTY OREGON PLAT RECORDS, IN LANE COUNTY, OREGON. Section 2: This resolution shall jake effect upon adoption by the Common Council of the City of Springfield and approval by the Mayor. Section 3: The City Council reclmmends that the Boundary Commission approve the proposed annexation as described in the recitals. Section 4: The City Manager shall forward this Resolution supporting the applicant's annexation request to the Lane County Local Government Boundary Commission. The area is I described on Lane County Assessorr Map 18-02-06-11, TL 600. The legal description ofthe property is Lot 3, Block 1, H.F. Franklin Addition, as platted and recorded in Book 14, Page 31, Lane County Oregon Plat Records, in Lane County, Oregon. Zoning The Low Density Residential (LDR) zoning of the subject property and uses are consistent with the Metropolitan Area General Plan (MJtro Plan). The property exceeds the minimum requirements for parcel size . and frontage on an east-west street (kt least 4,500 square feet and 45 feet of frontage per Springfield Development Code Article 16.030(1)). Sanitary Sewer The existing residence is not currently connected to the city sanitary sewer system. A sanitary sewer line runs east-west within North Street just oJtside the south property line. Additionally, a sanitary sewer lateral connection is stubbed into the subjett site near the northwest property comer. Solid Waste Management The City and Sanipac have an exclusive franchise arrangement for garbage service inside the city limits. Upon annexation, Sanipac will serve this ~roperty. . . . Water Service Rainbow Water District is currently serving the site with water and will coIltinue to do so until the July following the completion of annexation, at which time SUB Water will be the provider. Water service to the property originates from a 6-inch w~ter main in North Street. . _ Electric SUB Electric is currently serving the site with overhead power fromN?!1h Street. Fire and Life Safety The Fire Marshal has reviewed the application and has determined that fIre and einergency services are available to this site. . Police Protection Upon annexation, the area will receive police protection from the City of Springfield. Police protection and response to priority calls can be pro~ided to this site upon annexation consistent with service protection throughout the city. Parks and Recreation Programs , _ '.' . . After annexation to the City of Springfield, the subject property will be within the Willamalane Park and Recreation District boundary. City ~esidents receive park and recreation services from the District. The District operates two aquatic centers, a Conimunity Center, an Adult Activity Center, and 31 parks containing a variety I of outdoor recreational amenities. Land Use Controls The City of Springfield Development Services Department has provided all planning arid building functions for the citizens and property owners of It he subject property. The City of Springfield Development Services '. Department will continue to provide land use control for the site after the annexation. Communication Facilities Qwest and AT&T currently provide communications in the area for cable service and an array of wireless companies provide different commuhication services. The City has no exclusive franchise arrangements with telecommunication or wireless comdanies. The field is competitive and therefore guarantees a wide selection. Public Schools Public School services are available through School District 19. Mt. Vernon Elementary School is located just to the east ofthe subject property. Stormwater Control Roof runoff is directed onto the site, and passes through a shallow roadside swale along the North Street frontage of the property. The northern property frontage has been fully developed with curb, gutter, curb inlets, and underground piped storm water rhanagement facilities. This sitb is one of only a few remaining lots that have not been annexed . yet. In addition, all of the adjdcent properties are also zoned LDR with a low-density residential plan designation. There are n~ special site features (including wetlands, watercourses, or steep slopes) located on the subject broperty that is being annexed. The subject property is currenhy being used for single-family residential and is developed with one single-family dwelling wi~h attached garage. The only other existing improvement is a driveway. This annexation will allow a proposed partition to create three parcels out of one lot. . I . . The proposed development will be to have two additional single-family residential dwellings.. - This proposed de~elopmentlll be able to be served by a minimum level afkey urban facilities. - -- There are existing wastewaterl and storm lines located within South Redwood Drive, adjacent to I the subject property, which will serve the proposed development.
