NOTICE AND ORDER to abate a nuisance and unsafe condition at the
former Motor View Drive-In property - Tax Lot #1702 31 41 00100
Dear Ms. Lucks:
The City of Springfield 8uilding Safety Division recently
responded to a complaint at the above property which was alleged
to have an open pit without adequate protection.
The inspector who responded to. the comp 1 a i nt d i scov~red an open
septic tank adjacent to the. former snack bar area which apparently
was not pumped and backfilled in accordance with Oregon statute
requirements at the time the snack bar was demolished.
The existing situation is a violation of the City's Nuisance
Ordinance and State Specialty Codes which require potential
hazards and unsafe conditions to be properly corrected or abated.
The following corrective actions must be taken within the next 30
days:
The abandoned septic tank must be pumped and filled by a
person holding a sewage disposal service license as
provided for in Chapter 340, Division 7 of the. Oregon
Administrative Rules.
If you do not, take corrective action within the time frame
outlined above~ the City may' seek compliance through legal
recourse which may include Municipal Court proceedings or the City
may proceed to eliminate the hazard and charge the costs thereof
against the propertY,or its owners.

Any person having any record title or legal interest in this
property may appeal from th i s Not i ce and Order. to the Buil ding
Board of Appeals, provided that the appeal is made in writing and
filed with the City Building Official within thirty days from the
date of service of this Notice and Order. Failure to appeal will
constitute a waiver of all right to .an administrative hearing and
determination in this matter.
