5.2.2 Pass-by and Diverted Trips
For the, pmpose of estimating possible impacls on a street network, generaled trips include three
differenl kinds of trips:
. Pass-by - SlOpS of vehicles already passing by the driveway of the planned 'facility,
. Diverted - stops of vehicles \hal are already in the adjacent road system, but not right at the
driveway, and
. Primary/ New - 'trips that are completely generaled by the new facilitY.
In order 10 avoid double~counting of existing traffic, only' the newly generated trips are to be
considered when dealing wi\h a potent;~l impact on the adjacent street network; . For the facility
driveways, however, all traffic including new, diverted, and' pass-by trips ~e taken. into account.
For the proposed developmen~, it is assumed \hat 56% of the trips generated are pass-by trips

"Applicant", in accordance with Section 31.090, and Section 3.0'70(3), 3.080(31. 3.090(3)

RECITALS
WHEREAS, on the 16th day of July, 1996, the City approved the Final Site Plan
Application submitted by the Applicant for the purpose of the following:
CITY JOURNAL NUMBER 95.11-214. Type II Site Plan Review Application
requesting approval to construct a gas station with a convenience store and two
fast food outlets on a vacant site. The property is located 4095 Main Street,
(Assessor's Map 17.02-31.41; Tax lot 4500). The property is zoned CC.
WHEREAS, in consideration for a Type II Site Plan Review Application approval, the
issuance of a Building Permit, and the issuance of an Occupancy Permit, as specified in the
Springfield Development Code Section 31 .090, Applicant agrees to comply with all of the
standards in the Springfield Development Code and the Springfield Municipal Code which
may be applicable to this development project unless modified or excepted by the Site Plan
Review Development Agreement, Development Services Director, Planning Commission,
Building Official or their agents, or the Fire Marshall, which modifications or exceptions
shall be reduced to writing.
WHEREAS, in consideration for Site Plan approval, the issuance of a Building Permit,
and the issuance of an Occupancy Permit, as specified in the Springfield Development
Code Section 31.090, Applicant agrees to comply with the following specific conditions
imposed by the City as part of the Site Plan approval:
1. Post special groundwater protection measures required by SUB Water Division.
2. Detail sanitary sewer hookup points and connections to City specifications.
3. A Drainage and Grading Plan showing the ground gutters and pump area covered
and connecting to sanitary sewer, with separation from stormwater flow. Multi.
chamber oillwater separator catch basins must be provided for both storm sewer
inlets.
4. The recorded originals of the 7' public utility easements must be returned to the
City prior to occupancy.
5. The l TD bus stop must be relocated 20' to the east on Main Street prior to
occupancy.
6, S. 41 st Street fully improved to City standards prior to Final Occupancy.

7. The originals of the street dedications must be returned to the City prior to the
issuance of a Building Permit.
8. .'A noncombustible containment wall must surround the LPG tank pad prior to
occupancy.
9. The landscaping must include backflow devices, 6' solid sight obscuring
perimeter fence, and lighting approved by the City.
10. A 35' driveway access is permitted on 41 st Street. A 32' driveway access is
permitted on Main Street. The access to Main Street must be signed for ingress
only, The existing Main Street curbcut must be closed; street, curb, gutter and
sidewalk replaced.
11. A current access permit for Main Street from the Oregon Department of
Transportation must be submitted prior to occupancy.
12. The northbound approach of S. 41st Street to the Main Street intersection
must be re-striped to Right Turn and Left Turn lanes.
13. One bike rack capable of holding 4 bicycles is required prior to occupancy.
THEREFORE IN CONSIDERATION OF THE FOREGOING RECITALS WHICH ARE EXPRESSLY
MADE A PART OF THIS AGREEMENT, CITY AND APPLICANT AGREE AS FOLLOWS:
1. FINAL SITE PLAN. The Applicant has submitted a Final Site Plan in accordance
with Section 31.080 of the Springfield Development Code.
2. STANDARDS. The applicant agrees to fulfill all applicable standards specified in
the Springfield Development Code and the specific standards listed in the RECITALS prior
to the occupancy, unless certain conditions have been deferred to a later date in
accordance with Section 31.110 of the Springfield Development Code.
3. CONDITIONS. The applicant agrees to fulfill all specific conditions of approval
required by the City listed in the RECITALS prior to occupancy, unless certain conditions
have been deferred to a later date in accordance with Section 31 .110 of the Springfield
Development Code.
4. MODIFICATIONS. The Applicant agrees not to modify the approved Final Site
Plan without first notifying the City, Modifications to the Final Site Plan shall be reviewed
in accordance with Section 31 .100 of the Springfield Development Code.
5. MAINTAINING THE USE. The Applicant agrees to the following:
(a) The building and site shall be maintained in accordance with the
provisions of the Springfield Development Code in order to continue the use:

(b) It shall be the continuing obligation of the property owner to maintain the
planting required by Section 31.140 of the Springfield Development Code in an attractive
manner free of weeds and other invading vegetation. In addition, plantings in the vision
clearance area shall be trimmed to meet the 2 112 foot height standard in accordance with
Section 32.070 of the Springfield Development Code.
(c) Parking lots shall be maintained by the property owner or tenant in a
condition free of litter or dust, and deteriorated pavement conditions shall be improved to
maintain conformance with these standards.
(d) Undeveloped land within the development area shall be maintained free
of trash and stored materials in a mowed and attractive manner, Undeveloped land shall
not be used for parking.
6. In addition to all other remedies which may be provided by law or equity

Applicant agrees the City may enforce Applicant's responsibilities by withholding
Applicant's Final Occupancy Permit, and terminating any Temporary Occupancy Permit
which may have been granted.
7. Any Final Site Plan approves becomes null and void if construction does not
commence within one year of the date of the agreement.
