AGREEMENT BETWEEN GRAY'S GARDEN CENTER & CITY OF SPRINGFIELD
Gray's Garden Center, 4441 Main Street, Springfield, Oregon, is
requesting approval to place two modular structures behind the
existing primary garden center building. One of the buildings is
to be used as a lunch room, and the other as offices for the garden
center business.
The garden center is also being expanded to the adjoining property
to the east through a lease agreement with Matt Ritzdorf, the
adjoining property owner, and much of the property is being used
for plant storage and sales. Mr. Ritzdorf is leasing an existing
building, and a fenced space adjacent to the building, to a third
party at this time. The garden center owners are negotiating with
Mr. Ritzdorf to purchase the adjoining property, including the
building, with the intent of expanding their business. The intent,
after a purchase is completed, is to remodel the adjoining building
for use by the garden center, and to remove the modular structures.
The City Of Springfield is willing to allow the use of the two
modular structures to be considered temporary under the following
conditions:
1.
Gray's Garden Center shall make application for site plan
review for all of the property currently being used by the
garden center, and for the proposed uses intended on the
adjoining Ritzdorf property, within 21 days from the date of
this agreement.

Mr. Ritzdorf will be required to sign the application for the
portion of the site still under his ownership.
2. The temporary use of the two modular structures is approved
until July 1, 1996, at which time one of the following options
is required:
The adjoining building to the east shall be purchased or
leased from Mr. Ritzdorf, and the building shall be remodeled
to allow the office and lunch room functions to occur in the
permanent building. The two modular structures shall be
removed from the site.
The two modular structures shall be modified for permanent
installation, including foundation, tie downs, stairs, ramps
and handrails as required by The State Structural Specialty
Code. These items shall be permitted, inspected and approved
by the City Community Services Division, and a Certificate of
