Development Issues Meeting - Elder Health & Living Corp.
Proposed Vacation of South 58th Street ROW within Map 17-02-33-44, TL 1601
(Segment Between S. 58th. Street & Bob Straub Parkway)
Q1. What is the proper process of obtaining this portion of South 58th Street by Elder Health and
Living Corp? How to initiate it?
A: The City of Springfield holds the deed to this public right-of-way area, Planning staff understand
that a written request for disposition of surplus City property should be prepared and submitted
to the City Engineer. The City Surveyor will provide additional comments on this process.
Q2, What is the cost/time associated with the process of obtaining the property?
A: The City will need to undertake a competitive bidding process for the surplus property, and
conduct a public hearing for the surplus property disposition. There is no statutory time frame for
this process. The applicant is reminded that the City Council will be taking a summer recess
between July 22 and early September.
Q3. Are there any public/private utilities located in the existing right-of-way?
A: There shouldn't be any private utilities in'the existing public right-of-way. There may be shallow-
buried utilities such as natural gas, cable TV or telephone lines that cross the area. Springfield
Utility Board (Water) advises that a 2-ihch water line was installed to the applicant's property in
anticipation of future disposition of the right-of-way. A utility locate would be recommended, and
in any event the utility companies will be contacted if the property is being considered for surplus
sale. There is an existing 1O-inch and 12-inch public stormwater pipe inside the eastern edge of
the subject right-of-way as depicted on the applicant's sketch plan. The public stormwater pipe
still connects to two existing catch basins within the (now) vegetated area. The applicant may be
able to retain some connection points to the public system to serve future development on the
right-of-way area, if this is pursued.
Q4. Are there any easement[s] that need to be retain[ed]?
A: If the property is deemed surplus and sold, the City will require a 10-foot wide public utility
easement (PUE) along the S 58th Street and Bob Straub Parkway frontages of the property.
Q5. All the properties immediately adjacent to the right-of-way proposed for vacation belong to
Elder Health and Living Corp. Are there any other properties considered affected by this
right-of-way vacation?
A: Other adjacent properties would be .notified in the event the subject area is offered for surplus
sale. However, unlike a street right-of-way' vacation, the public notification area would not
automatically extend to the next adjacent public street.
