SUBJECT: ZON2009-00016 Elder Health Care ROW Vacation DIM
Public Works Engineering Comments
The subject application involves tax lot 1601, located at the intersection of S58th Street and S
57th Place. The applicant submitted plans to discuss the possibility of vacating ROW along a
portion of S58th at Bob Straub Parkway in order to utilize area to construct an addition to their
assisted care facility.
Applicant's Questions:
1. What is the proper process of ohtaining this portion of South 58th Street by Elder
Health and Living Corporation? How to initiate it?
A vacation process may not necessarily transfer title to the adjoining property owner as
the City acquired the property by deed Research of the title of both the right of way and
adjoining lands would be needed to determine who the owner of the right of way land
might be if vacated The applicant could consider making a request to the City to dispose
of it as surplus property,
2. What is the cost I time associated with the process of obtaining the property?
This will depend on what process the applicant chooses and will be discuss further at the
DIM meeting
3. Are there any public I private utilities located in existing right-of-way?
There is a 10" storm pipe crossing the right-of-way wit inlets at each end and a 12"
storm pipe running longitudinally along the west side of the right-of-way, Attached, is a
Map Spring plan print-out showing the approximate pipe locations, The Springfield
Utility Board (SUB) should be contacted for other utilities that may be present.
4. Are thel:e any easements that need to be retained?
There is a 10 foot PUE along the adjoining right of ways created by the right of way
deed The city would still want to retain a 10 footPUE along the right of way of S 57th
Place if the right of way were vacated or sold
5. All the properties immediately adjacent to the right-of-way proposed for vacation
belong to Elder Health and Living Corporation. Are there any other properties
considered affected by this right-of-way vacation?
Vacation process does not appear to be a recommend process, The City Surveyor will
respond further to this question
