Finding: The north side of the building which faces the street is approximately 80 feet in length and includes the two proposed unenclosed deck areaS which are each 24' feet in length. These covered areaS extend out 25' from the original building. A combination of stucco, lap siding; rock and open beam construction is shown on the exterior building fa~ade. The propos'" meets the criteria of this section. B. Building Orientation and Maximum Setbacks Finding: The additionS to the building' provide closer proximity to the street and proposed 5' internal sidewalks connect the building and customer ~ntrance to the public sidewalk which meets the applicable criteria of this section. C. Weather Protection Finding: The addition of 2' t<:> 6' wide structural eaves and entryways arepiiiposedon all si!les of the building to provide, architectural interest to the building and'weather protection. The'west side of the building limits the width of the eave due to the existing access easeinent 'across the . property. Although tJ:iis proposal does not meet all of the criteria of subsectionS 1 t1:irough,5, it does comply with,subsection 6 in that it provides an equally good or superior way to achievethe, intent of this section. .' D. Landscaping and Screening Finding: This section requires screening of parking areas, drives, mechanical equipment and trash receptacles. Currently the parking area and other paved areas me~t the sidewalk area with no planted setback separation. There is a 19' right-of"way area comprised of sidewalk and planter strip in between the site'and M Street. The applicant proposes moving the sidewalk north 5' in order to create a 5' wide planter strip to accommodate evergreen shrubs to screen the parking lot, proposed CMU wall for the smoking area and the trash receptacle area. A five foot wide, sidewalk is shown and to the north between the sidewalk and street is an additional 9 foot wide planter strip conWning lawn and street trees. 'Including the condition below regarding maintenance of the plantings in the right of way, this proposal meets the criteria of this sectiori. E. Street Connectivity and Internal Circulation Finding: An existing access way from the street across this property to the adjacentshopping center will remam.. Two separate pedestrian acessways are proposed from the site to the public ,sidewalk. A condition listed below under section (E) addresses handicap access and connectivity. The existing and proposed improvements to the site meet the criteria of this section. . , . , F. Neighborhood Compatibility Finding: Two single family homes exist across M Street, an 80' right-of-way, on the western side of the property and are zoned Low Density Residential. The houses are parallel to the parking lot and access easement portion of the site and are located diagonally across from the smoking addition. A six foot high CMU wall is proposed at the property line north of the open smokingareas with evergreen shrubs directly adjacent to the wall. Condition 1: All additions and improvements to the building must be constructed as shown on the approved plan with conditions incorporated in order to comply with the Mixed Use Development Standards. Condition 2: Shrubs in the screening planter strip permitted in the right-of-way shall be continually maintained by the property owner. Street trees in the larger planter strip shall be maintained by the City of Springfield subsequent to the two-year warranty period (Section 6.02.5 of the Engineering and Design Standards and Procedures Manual). Condition 3: On-site lighting shall be the minimum illumination necessary for a given application including parking areas. All exterior light fixtures shall be shielded or recessed so that direct glare and reflection are contained within the boundaries of the property and directed downward and away from abutting properties and rights-of- way. The height of a free standing exterior light fixture shall not exceed 25 feet or the height of the permitted structure, whichever is less. Provide detail for any proposed exterior lighting which complies with the standards listed above. No screen other physical obstruction is permitted between 2 1/2 and 8 feet above the height of the curb in the triangular area. Because the proposed planter strip is being permitted in the right-of- way between property line and the sidewalk the vision clearance triangle shall include the planter strip in order to provide adequate sight distance to the sidewalk.area. The proposed 6' fence shall be located outside the vision clearance triangle and the proposed shrubbery shall not exceed 21/2 feet in this area. Condition 10: The applicant will be permitted 180 days from the date of this decision to submit a Traffic Study for approval of the additional driveway. In order to complete the review process, a Development Agreement is required within 45 days from the date of this decision to ensure the terms and conditions. of this application are binding upon both the applicant and the City. This agreement will be prepared by Staff and upon approval of the Final Plot Plan, must be signed by the property owner prior to issuance of a building permit and land use approval. The construction of the required improvements shall begin withili'90 days of the date of this decision. If the established time line cannot be met, the applicant may submit a written request for a time line extension as specified in SDC Section 5.15-125. The Director may allow a one-time extension of the 90-day start of construction time line due to situations . including but not liinited to, required permits from the City or other agencies; weather conditions and the unavailability of asphalt or the unavailability of street trees. If the time extension is allowed, security shall be provided as specified in SDC Section 5.17-150 of this Article. The time line extension shall'not exceed 90'days. ' If the established time line is not met and the applicant has not requested an extension, the Director shall declare the application null and void if the property is occupied and the property owner shall be considered in violation of this Code. If the established time line is not met and the applicant has requested an extension and that time line has not been met, the Director may require the improvements be installed as specified in SDC Sectiop 5.7-150. PERMITS lHAT MAY BE REQUIRED:. . All new sewer taps will require permits from the Public Works Department prior to connection. Sidewalks and driveway curb cuts' and closures require permits from the Public Works Department. Building permits will be required for the construction ofthe Iiuilding and the paving oftbe parking lot. An LDAP permitwill be required for all grading, filling and excavating being done. Sign Permit-NOTE: Signs are regulated by the Springfield Municipal Code Article 9, Chapter7: The number and placement of signs must be coordinated with the Community Services Division. The location of signs on a Site Plan does not constitute approval from the Community Services Division. . . . . .
