HomeMy WebLinkAboutResolution 09-26 07/06/2009 RESOLUTION NO. 09-26 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD REGARDING THE PURCHASE AND SALE OF THREE PARCELS OF LAND CURRENTLY OWNED BY THE STATE OF OREGON, DEPARTMENT OF ADMINISTRATIVE SERVICES WHEREAS, the City of Springfield ("City") and the Springfield Economic Development Agency ("SEDA") have entered into several intergovernmental agreements pledging cooperation and collaboration in the implementation of the Glenwood Urban Renewal Plan. WHEREAS, during calendar year 2008, the City completed its Stormwater Facilities Master Plan that now includes Glenwood. One of the key strategies in the plan is for the City to purchase easements and property for key segments of urban stormwater drainage system. WHEREAS, the State of Oregon, Department of Administrative Services has for sale the three parcels in Glenwood that could help facilitate stormwater drainage for the Glenwood area. WHEREAS, on January 12, 2009 the Springfield Economic Development Agency granted the City Manager authority to execute a Purchase and Sale Agreement'with the State of Oregon, Department of Administrative Services, for the three parcels of land on the southwest side of Glenwood, adjacent to Franklin Blvd. WHEREAS, initial plans called for SEDA to purchase the land but it now appears. more appropriate for the City to acquire the property in furtherance of the Stormwater Management Plan and once City easements and/or property ownership is reserved for the public stormwater system, the City will then sell the balance of the property to best recoup costs of the property acquisition and then, to the extent the City has proceeds from the sale of the remnant property, the City will forgive SEDA's revolving loan fund debt to the City up to the cost of the property acquisition. WHEREAS, the City has the $700,000.00 available in the revolving loan fund (Fund 420) to cover the expenditure. The City's selling the property and forgiving . SEDA's debt to the City preserves the SEDA line of credit with the City and acknowledges the value of SEDA's funding the cost of obtaining the property and easements for the publiC stormwater system for the City. NOW THEREFORE, the Common Council of the City of Springfield hereby now resolves . as follows: 1. City Manager, Gino Grimaldi is authorized to execute the Purchase and Sale Agreement and any other deeds or documents necessary to acquire the three parcels of land in Glenwood currently owned by the State of Oregon, Department of Administrative Services; and 2.
