Andy Limbird (}.tJ- . x3784 ~ 10 minutes AGENDA ITEM SUMMARY SPRINGFIELD CITY COUNCIL ITEM TITLE: ANNEXATION OF TERRITORY TO THE CITY OF SPRINGFIELD (White - Case Number LRP2007-00016) ACTION REQUESTED: Conduct a public hearing and adopt/not adopt the following resolution: A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE ANNEXATION ISSUE STATEMENT: ATTACHMENTS: DISCUSSION: The property owner, Terry White, has requested annexation of x1S,888 square feet of property located at 4080 North Street. The site currently contains one residence. The purpose of the annexation is to facilitate a property partition and to allow the . existing dwelling to connect with City sewer service. The legal description of the property to be annexed is more particularly described in Attachment I, Exhibit A. Attachment I: Resolution and Exhibits Attachment 2: Informational Attachment Attachment 3; Maps Attachment 4: Submittal from Applicant The City Council is authorized by ORS I 99.490(2)(a)(B) to initiate annexation upon receiving consent in writing from a majority of the electors registered in the territory to be annexed and the owners of more than half of the land to be annexed. Consent from all the property owners has been given. Lane County Elections advises there are no registered electors at the subject property. With Council approval, this resolution will be forwarded to the Lane County Local Government Boundary Commission for further consideration. The property to be annexed contains an existing house and is located inside the Urban Growth Boundary (UGB). The current City limits run. along the northern and eastern boundaries of the site. The applicant requests annexation in order to connect the existing house to City sewer and to facilitate partitioning the property in accordance with provisions of the Low Density Residential (LDR). district. . In accordance with Springfield Development Code Article 6.030(2), the site already is (or can be) served with key urban facilities and services, includirig but not limited . to City utilities, police, fire protection, library, parks and recreation, imd schools. A full suite of public utilities are immediately available to serve the subject property. An existing sanitary sewer line runs within North Street along the frontage of the south property line. Additionally, there is a sanitary sewer lateral stubbed into the northwest comer of the property adjacent to South Redwood Drive. Because the required City utilities are immediately available to the property, it is the determination of staff that an Annexation Agreement is not required for this annexation request. RESOLUTION NO A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOVNDARY COMMISSION APPROVE THE ANNEXATION WHEREAS, the City received arequest to annex approximately 15,888 square feet (0.36 acres) into the City of Springfield on April 18, 2007, said territory being de~cribed as follows: Township 18 South, Range 2 West, Section 6, Map 11, Tax Lot 600 (commonly known as 4080 North Street, Springfield) as 'generally depicted in Exhibit A and more particularly described as LOT 3, BLOCK 1, H.P. FRANKLIN ADDITION, AS PLATTED AND RECORDED IN BOOK 14, PAGE 31, LANE COUNTY OREGON PLAT RECORDS, IN LANE COUNTY, OREGON. WHEREAS, the territory proposed to be annexed is within the Eugene-Springfield Urban Growth Boundary, and is adjacent to the City Limits; arid, WHEREAS, the Common Council is authorized by ORS 199.490(2)(a)(B) to initiate annexation upon receiving consent in writing from a majority of the electors registered in the territory proposed to be annexed and written consent from owners of more than half the land in the territory proposed to be annexed; and, WHEREAS, one hundred percent ofthe property owners of the territory signed a consent to annex (Exhibit B); and, WHEREAS, there are no registered electors residing within the territory proposed for annexation (Exhibit C); and, WHEREAS, the City Council is authorized by Springfield Development Code 6.070,ORS 222.111 and other applicable Oregon Revised Statutes to initiate amiexation when the territory in the annexation proposal can be provided with the minimum key level of urban facilities and services in an orderly and efficient manner as defined in the Eugene-Springfield Metro Area General Plan Policy 8, Page II-B-4, and where there will be a logical area and time within which to deliver urban services and facilities; and, WHEREAS, minimum level of key urban services and facilities are defined in the Eugene-Springfield Metro Area General Plan, Page V -3 as sanitary sewer service, stormwater service, solid waste management, water service, fire and emergency medical services, police protection, city-wide parks and recreation programs, electric service, land use controls, communiGation facilities and services, and public schools on a district-wide basis; and, WHEREAS, the territory proposed to be annexed can be immediately provided with a minimum level of key urban facilities and services, with the exception of City stormwater and sanitary sewer services which are available along the public street frontages of the property; and, WHEREAS provision of City storm water and sanitary sewer services can be provided in an orderly and efficient manner and does not require an Annexation Agreement; - ATTACHMENT 1-1 NOW THEREFORE BASED ON THE FOREGOING RECITALS, THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: Section 1: The Common Council of the City ofSpringpeld does hereby recommend approval of the annexation ofthe subject territory to the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territory being described as follows: Township 18 South, Range 2 West, Section 6, Map 11, Tax Lot 600 (commonly known as 4080 North Street, Springfield) as generally depicted on Exhibit A and more particularly described as LOT 3, BLOCK 1, RF:FRANKLIN ADDITION, AS PLATTED AND RECORDED IN BOOK 14, PAGE 31,LANE;COUNTYOREGON PLAT RECORDS, IN LANE COUNTY, OREGON. , ,..>-. < ~: /--' Section 2: This resolution shall take effect upon adoption by the Common, Council of the City of Springfield and approval by the Mayor. The area is described on Lane County Assessor's Map 18-02-06-11, TL 600. The legal description of the property is Lot 3; Block 1, H.F. Franklin Addition, as platted and recorded in Book . 14, Page 31, Lane County Oregon Plat Records, in Lane County, Oregon. Zoning The Low Density Residential (LDR) zoning of the subject property and uses are consistent with the Metropolitan Area General Plan(Metro Plan). The property exceeds the minimum requirements for parcel size and frontage on an east~west street (at least 4,500 square feet and 45 feet of frontage per Springfield Development Code Article 16.030(1)). '" ,'t Sanitary Sewer The existing residence is not currently connected to the City sanitary sewer system. A sanitary sewer line runs east-west within North Street just outside the south property line. "," ..- .{..; Solid Waste Management The City and Sanipac have an exclusive franchise arrangement for garbage service inside the city linlits. Upon annexation, Sanipac will serve this propeity. . Water Service Rainbow Water District is currently serving the site with water and will continue to do so until the July following the completion of annexation, at which time SUB Water will be the provider. Water service to the property originates from a 6-inch water main in North Street. Electric SUB Electric is currently serving the site with overhead power from North Street. Fire and Life Safety The Fire Marshal has reviewed the application and has determined that fire and emergency services are available to this site. . . Police Protection Upon annexation, the area will receive police protection from the City of Springfield. Police protection and response to priority calls can be provided to this site upon annexation consistent with service protection throughout the city. .. Parks and Recreation Programs After annexation to the City of Springfield, the subject property will be within the Willamalane Park and Recreation District boundary. City residents receive park and recreation services from the District. The District operates two aquatic centers, a Community Center, an Adult Activity Center, and31 parks containing a variety of outdoor recreational amenities. Land Use Controls The City of Springfield Development Services Department has provided all planning and building functions for the citizens and property owners 'of the subject property. The City of Springfield Development Services Department will continue to provide land use control for the site after the annexation. ATTACHMENT 2-1 Communication Facilities Qwest and AT&T currently provide communications in the area for cable service and an array of wireless companies provide different communicatioll services. The City has no exclusive franchise arrangements with telecommunication or wireless companies. The field is competitive and therefore guarantees a wide selection. Public Schools 'Public School services are available through School District 19. Mt. Vernon Elementary School is located just to the east of the subject property. Stormwater Control Roof runoff is directed onto the site, and passes through a shallow roadside swale along the'North Street frontage of the property. The northern property frontage has been fully developed ~ith curb, gutter, curb inlets, and underground piped stormwater management facilities. Through this annexation the property owner seeks the ability to connect to the existing public wastewater and stonn systems as well as other existing public utilities. In addition, the annexation will allow future residents of a partition to receive all city services. This site is one of only a few remaining lots that have not been annexed .. yet. In addition, all of the adjacent properties are .also zoned LDR with a low-density residential plan designation. There are no .special site features (including wetlands, watercourses~ or steep . slopes) located on the subject property that is being annexed. The subject property is currently being used for single-family residential and is developed with one single-family dwelling with attached garage. The only other existing improvement is a driveway. This annexation will allow a proposed partition to create three parcels out of one lot. . The proposed development wi~l be to have two additional single-family Fesidential dwellings. This proposed development will be able to be served by a minimum level Of key urban facilities. There are existing wastewater and storm lines located within South Redwood:Qrive, adjacent to the subject property, which willse.rve the proposed development. In addition, there are existing overhead electric lines and water mains adjacent to the annexation site. There is also existing bus service along Main Street near 42nd Street that will be able to serve the subject property. Given these facts, there is a minimal level of key urban facilities to serve the subject site. ... :. ..
