ORDINANCE NO. 5827
(GENERAL)
AN ORDINANCE AMENDING THE SPRINGFIELD DEVELOPMENT CODE APPENDIX 1 DEVELOPMENT
CODE FEES (JO. NO. 96-04-98)
THE CITY COUNCIL OF THE CITY OF SPRINGFIELD FINDS mAT:
1. The Springfield Development Code (SDC) was adopted by the Springfield City Council on May 5,
1986, and amendments thereto were subsequently adopted by Ordinance.
2. On May 21, 1996, the Springfield Planning Commission held a public hearing on this SDC
amendment request (Jo. No. 96-04-98). The Springfield Planning Commission voted 2- in favor and ~ opposed, to
recommend approval of these amendments to the City Council.
3. Findings in support of adoption of these amendments to the SDC are set forth in the Staff Report and
the Recommendation to the Council (Jo. No. 96-04-98) incorporated herein by reference.
4. Based on the above record and findings, the City Council concludes that the SDC amendments are
consistent with the criteria of approval as set forth in the Staff Report and Recommendation to the Council by the
Springfield Planning Commission (Jo. No. 96-04-98), incorporated herein by reference.
Now therefore, based on the above findings,
THE CITY OF SPRINGFIELD CITY COUNCIL DOES ORDAIN AS FOLLOWS:
Section 1: Appendix 1, DEVELOPMENT CODE FEES, is hereby amended as follows:

(*) Development in the HS Overlay District that requires Site Plan Review shall be charged only the Site Plan
Review fee. Development in this District that requires Discretionary Use approval shallbe subject only to the fee
for Discretionary Use/Site Plan Review.
(**) This fee applies only to land divisions in the Hillside Overlay District (Article 26) and is in addition to the
land division review fee.
(***) The fee for an Expedited Land Division (ELD) includes $600.00 to defray costs of a Hearings Official in
the event the decision is appealed. If the decision is not appealed, the applicant for the ELD shall be refunded
$600.00. A separate postage fee of $100.00 is required for an ELD.
NOTE: All Type II applications, except where noted in this Appendix, are subject to a separate postage fee of
$50.00.

for this type of appeal if the land subject to the decision is within the boundaries of the Association.

(*****) An appeal of a Hearings Official decision involving an urban transition area land use decision is filed
with the State Land Use Board of Appeals.
NOTE FOR ALL LOCAL APPEALS: If an appellant prevails at the hearing or subsequent hearing, the fee for
the initial hearing shall be refunded.
NOTE FOR HEARINGS OFFICIAL DEPOSIT: Any amount not expended shall be returned to the
applicant. Charges in excess of the $600 deposit shall he assessed to the applicant.

Section 2: If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the validity of the remaining
portions hereof.
