ORDINANCE NO. 5818
(Special)
AN ORDINANCE VACATING A 2,406 SQUARE FOOT PORTION OF A
PUBLIC UTILITY EASEMENT RECORDED SEPTEMBER 1,1995 IN REEL 2093R
AT RECEPTION NUMBER 9549189 IN LANE COUNTY OREGON DEED
RECORDS (ASSESSOR'S MAP 17-03-23, TAX LOT 1000)
WHEREAS, River Glen L.L.C. has declared its intention to vacate a portion of a
public utility easement in the City of Springfield as described in exhibit A; and
WHEREAS, such vacation is in the best interest of the City in carrying out its
plans and programs for the general development of the City; and
WHEREAS, lawful notice of the proposed vacation was published and posted;
and
WHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth
Street, on Monday, the 2nd day of April 1996, at the hour of7:00 p.m., to hear any
objections to the proposed vacation and ~ persons appeared to object;

NOW, THEREFORE, BASED ON THE FOREGOING RECITALS THE COMMON
COUNCIL DOES ORDAIN AS FOLLOWS:
Section 1: Legal notice of the hearing was lawfully published and posted; that
-L objections were made at the vacation hearing held; that public interest will not be
impaired by the vacation of the easement; and that said vacation will be in the best
interest of the public and increase the benefit of the property involved.
Section 2: That portion ofthe public utility easement specifically described in"
exhibit "A" is declared to be vacated. '
Section 3: The findings in the staff report for 10. No. 96-02-42 are hereby made
part of this ordinance by reference.
Section 5: The City Recorder is directed to file certified copies of this Ordinance
with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor.

ADOPTED by the Common Council of the City of Springfield this 15th day of April,
1996, by a vote of ~ for and ~ against. <-

PHASE 1
VACATION OF PUBLIC UTILITY EASEMENT
BY THE CITY OF SPRINGFIELD
SITUATED in UNINCORPORATED AREA abutting the City of Springfield, Lane
County, State of Oregon in the Southeast 1/4 of Section 23, Township 17 South,
Range 3 West of the Willamette Meridian and described as follows:
BEING a portion of that certain PUblic Utility Easement conveyed to THE CITY OF
SPRINGFIELD, a municipal corporation in Lane County as said easement was'
recorded September 1, 1995 in Reel 2093R at Reception Number 9549189 in Lane
County Oregon Deed Records, said portion being more particularly described as
follows:
COMMENCING at the southwest corner of Lot 1, Block 3 of the plat- of "FIRST
ADDITION TO NORTHWOOD ESTATES" as platted and filed May 14, 1964 in Book 41
at page 13 in LANE COUNTY OREGON PLAT RECORDS; THENCE NORTH 1681. 70
FEET and WEST 1198.32 FEET to the northwest terminus of Line No. "E17" as said
line is shown on aforesaid conveyance, said northwest terminus being the TRUE
POINT OF BEGINNING of the portion being described herein;
THENCE, leaving said TRUE POINT OF BEGINNING, along said Line No. "E17"
SOUTH 220 46' 29" EAST 166.45 FEET to a point on west line of that certain 10-Foot
Wide Public Utility Easement as conveyed to aforesaid CITY OF SPRINGFIELD by
document recorded December 12, 1995 in Reel 2122R at Reception Number 9570988 in
Lane County Oregon Deed Records;
THENCE NORTH 180 OS' 06" EAST 15.29 FEET along said west line to a point on Line
No. "Ell" as said line is shown on the first-called conveyance to the CITY OF
SPRINGFIELD; ,
THENCE, along said Line No. "Ell", NORTH 220 46' 29" WEST 107.59 FEET;
THENCE, along Line No. "ElO" as said line is shown on the first-called conveyance
to the CITY OF SPRINGFIELD, NORTH 6r 13' 31" EAST 16.66 FEET to the north
end of Line No. "E2" as said line is shown on aforesaid la-Foot Wide Public Utility
Easement as conveyed to the CITY OF SPRINGFIELD by document recorded in Reel
2l22R at Reception Number 9570988 in Lane County Oregon Deed Records;
THENCE, along the northwesterly prolongation of said Line No. "E2" f NORTH 240

first-called conveyance to the CITY OF SPRINGFIELD; and
THENCE, along said Line No. "E18", SOUTH 570 24' 14" WEST 25.07 FEET
RETURNING to the POINT OF BEGINNING and CONTAINING 2406 SQUARE FEET
(0.06 ACRES) more or less.
THE BEARING NORTH 000 53' 00" EAST of the west line of said plat of "FIRST
ADDITION TO NORTHWOOD ESTATES" was taken as the BASIS OF BEARINGS for
the above legal description.
