Backaround/Site Information The properties involved are located within the City of Springfield in the 5200 block of Main Street. The lots are zoned Community Commercial (CG) on the City of Springfield Zoning Map, the Metropolitan Plan, and the East Main Refinement Plan. The site is flat, currently undeveloped, and under one ownership. The owner would like to build a bank on the newly configured Tax Lot 7200, which will share joint access from South 52nd Place and Main Street with Tax Lots 7201, 7202, and 7203. Decision The Development Services Department of the City of Springfield grants Preliminary Approval for your proposal to adjust the property lines between Tax Lots 7200, 7201, 7202, and 7203 of Lane County Assessor's Map 17-02-33-31, located on Main Street and South 52"" Place. The criteria for preliminary approval have been met as shown below. All criteria for Final Map Approval shall be completed within 90 days of the date of this letter. Criteria of Aooroval IRef. Section 33.030 of the Sorlnafield Develooment Code\ The application shall b~ approved, approved with conditions, or denied based on compliance with the criteria of Section 33.030 of the Springfield Development Code. The statement below each of the criterion verifies compliance with the criterion and supports the approval of the lot line adjustment. The proposed lot line adjustment shall not: (1) CREATE A NEW LOT OR LAND-LOCKED PARCEL; The proposal is to adjust the interior lot lines of the above tax lots. This lot line adjustment will not create a new lot or any land-locked parcels. The adjustment reconfigures Tax Lots 7200, 7201, 7202, and 7203 to allow for future development off improved public streets via a joint use access maintenance agreement. L)~S'\ , ~\(\ 0t, . . .', (2) REDUCE AN EXISTING LOT BELOW THE MINIMUM DIMENSIONS ESTABLISHED BY THE APPLICABLE ZONING DISTRICT OR OTHERWISE VIOLATE STANDARDS OF THIS CODE, OR STRUCTURAL SPECIALTY AND LIFE SAFETY CODE STANDARDS; The proposed lot line adj~stment does not create a lot size smaller than the minimum size established in the Springfield Development Code for lots in the Community Commercial zoning districts. No other codes or standards are violated. (3) IMPEDE THE IMPLEMENTATION OF ADOPTED TRANSPORTATION OR PUBLIC FACILITIES PLANS OR APPROVED CONCEPTUAL DEVELOPMENT PLANS; The proposed lot line adjustment does not impede the implementation of other plans. The proposed lots would have access on improved public streets. The property owner has proposed a joint use access utility maintenance agreement which will provide 52"" Place and Main Street access to Tax Lots 7200, 7201, 7202, and 7203. (4) VIOLATE ANY PREVIOUS REQUIREMENTS OR CONDITIONS THE APPROVAL AUTHORITY MAY HAVE IMPOSED AT A PRIOR PUBLIC HEARING OR MEETING; AND The applicant has submitted Tentative Site Plan 98-01-030 to develop Tax Lot 7200 and provide a joint use access agreement for Tax Lots 7201, 7202, and 7203. This lot line approval does not violate requirements or conditions of those actions. (5) REDESIGN OR RECONFIGURE LOTS WITHIN A SUBDIVISION BY A SERIES OF LOT LINE ADJUSTMENTS. LOT LINE ADJUSTMENTS WHICH CREATE TWO LOTS FROM THREE LOTS SHALL NOT BE CONSIDERED A REDESIGN OR RECONFIGURATION OF LOTS, This lot line adjustment does not reconfigure a subdivision. The parcels are not part of a platted subdivision of Lane County, Oregon. FINAL MAP APPROVAL In order to receive Final Map Approval, the following criteria and specifications must be contained on the Final map: 1. A surveyor shall set new property pins and create new legal descriptions for the properties. 2. A Final Map shall be prepared which meets the Lane county Surveyor's standards for the land survey. The Final map shall include the following language: "FINAL MAP" "This Lot Line Adjustment modifies Tax Lots 7200, 7201, 7202, and 7203 on assessor's Map 17-02-33-31, Lane County records, Lane County, Oregon.' 3. The Final Map shall be platted in the Lane County Surveyor's Office. A copy of the recorded Final Map shall be delivered to the Springfield Development Services Department. If the Director determines that the Final map is acceptable, then a "Final Approval Notice" shall be mailed to the applicant within five working days following receipt of the Final Map. 2 'l . . APPLEAL In the event the applicant disagrees with this decision, you may request a Type II Interpretation pursuant to Article 4 of the Springfield Development Code. If you subsequently wish to appeal the Type II Interpretation decision, your appeal must be submitted in accordance with the Springfield Development Code, Article 15, APPEALS.
