ORDINANCE NO. 5785
AN ORDINANCE AMENDING THE EUGENE-SPRINGFIELD METROPOLITAN AREA GENERAL
PLAN (METRO PLAN) DIAGRAM AND REZONING CERTAIN PROPERTIES LOCATED NORTH
OF MARCOLA ROAD, EAST OF 19TH STREET, WEST OF 31 ST STREET AND SOUTH OF
YOLANDA, AS DESCRIBED BY ASSESSOR'S MAP AND TAX LOT NUMBERS IN TABLE ONE
(ATTACHMENT 1) (EXCEPTING AREA 4), CITY OF SPRINGFIELD, APPLICANT (JO. NO. 95-2-
36), AND DECLARING AN EMERGENCY.
WHEREAS, the City of Springfield initiated a request (Jo. No. 95-02-36) to amend the
Metro Plan Diagram and to change zoning districts for certain properties in North
Springfield, as described in Table One (attached); and,
WHEREAS, the request has been initiated to resolve conflicts between zoning districts
and Metro Plan designations that present constraints for development of the subject
properties; and,
WHEREAS, on April 4, 1995, the Springfield Planning Commission held a public
hearing on these Metro Plan Diagram amendment and rezoning requests. The
Springfield Planning Commission voted 7 in favor, none opposed, to recommend
approval of the Metro Plan Diagram amendments and zone changes to the City
Council; and,
WHEREAS, findings in support of adoption of this request are set forth in the staff
report and the Planning Commission recommendation to the Council (Jo. No. 95-02-
36), incorporated herein by reference; and,
WHEREAS, based on the adopted findings, the City Council concludes that the
amendments to the Metro Plan Diagram, and the rezonings, are consistent with the
criteria of approval as set forth in the staff report and the recommendation to the
Council by the Springfield Planning Commission (Jo. No. 95-02-36), incorporated
herein by reference.
WHEREAS, after conducting a public hearing on this matter on May 15, 1995, the City
Council concludes that further review by staff, the Planning Commission, and the City
Council of the portion of this request described as Area 4 is warranted prior to
adopting a Metro Plan designation and zoning district for this area.
NOW, THEREFORE, THE CITY COUNCIL DOES ORDAIN AS FOLLOWS:
The Metro Plan Diagram land use designations and zoning districts of the properties
described in Attachment 1 (except for the property described as Area 4), are hereby
amended/changed to correspond with the legal descriptions and map found in
Attachment 2.
The following conditions shall apply to all future development proposals within the area
subject to this Ordinance:
1. A landscaped buffer area, at a minimum of 20 feet wide, is to be provided
along the northerly boundary of Area 5 (on Map 1, attached) as part of any

development approval. The buffer area is to be landscaped and irrigated, and
should include two rows of trees planted 30' on center (or an equivalent
number of trees in grouped plantings). Fencing may be incorporated into the
buffer area, however, at least half the landscaped buffer area shall be north of
any constructed fence. The buffer area shall be maintained as an aesthetic
< open space area by commercial enterprise developed to the south, and it shall
be in addition to meeting the Springfield Development Code Article 31
landscaping requirements for the development area.
2. Development of Area 2 (on Map 1, attached) shall include a landscaped set
back of at least 15 feet from boundaries contiguous with low density
residential-zoned areas, and all residential structures in the medium density
residential-zoned area within 50 feet of the boundaries contiguous with low
density residential-zoned areas shall be single story.
Section 1. In support of this Ordinance, the City Council adopts the findings set forth
in Exhibit "A" attached and incorporated herein.
Section 2. Notice of the public hearings before the Planning Commission and City
Council were published in a local newspaper of general circulation in conformance with the
provisions of the Springfield Development Code Section 14.030.
