HomeMy WebLinkAboutOrdinance 5788 06/05/1995 '"t - t....:J,j . . . ORDINANCE NO. 5788 (SPECIAL) AN ORDINANCE VACATING A 19 FOOT WIDE PUBLIC UTILITY EASEMENT, AND DECLARING AN EMERGENCY. WHEREAS, the Springfield City Council has declared its intention to vacate a 3 foot wide public utility easement in the City of Springfield; and WHEREAS, such vacation is in the best interest of the City in carrying out its plans and programs for the general development of the City; and WHEREAS, lawful notice of the proposed vacation was published on May 10, 1995 and posted on May 19, 1995; and WHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth Street, on Monday, the 5th day of June, 1995, at the hour of 7:00 p.m., to hear any objections to the proposed vacation and l persons appeared to object; NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS: Section 1: The Council finds that the legal notice of the hearing was lawfully published and posted; that -1L objections were made at the vacation hearing held; that the public interest will not be impaired by the vacation of this public utility easement, and that vacation of said easement will be in the best interest of the public and increase the benefit of the property involved. Section 2: That following described easement is hereby vacated: Beginning at the Initial point of the GATEWAY PARK SECOND ADDITION, as platted and recorded in Book 66, Page 26, Lane County Oregon Plat Records; thence along the Southerly boundary of said plat South 89044' 00" East 19.00 feet; thence leaving said boundary South 00 25' 19" West 300.32 feet; thence North 890 44' 00" West 19.00 feet to the Easterly margin of South 49th Street; thence along said margin North 00 25' 19" East 300.32 feet to the Point of Beginning, Lane County, Oregon. Section 3: The findings are included in the staff report (Jo. No. 95-04-79) are hereby made part of this ordinance by reference. Section 4: The City Recorder is directed to file the certified copies of this ordinance with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor. Section 5: It is hereby found and determined that this matter pertaining to the vacation of the public utility easement is necessary for the immediate preservation of the public health, safety and welfare, therefore this ordinance shall take effect immediately upon passage by Council and approval of the Mayor.
