ORDINANCE NO. 578Qku(Special) AN ORDINANCE WITHDRAWING CERTAIN REAL PROPERTY LOCATED IN NORTH SPRINGFIELD WEST OF GAMEFARM ROAD SOUTH, EAST OF INTERSTATE 5 AND NORTH OF BEL TUNE ROAD; (17S R03W S15 PORTIONS OF PARCELS 1118,2800,2900.3000, AND 3100); HERETOFORE ANNEXED TO THE CITY OF SPRINGFIELD FROM THE RAINBOW WATER DISTRICT AND DECLARING AN EMERGENCY. WHEREAS, certain real property (Gamefarm Road) described below was annexed to the City of Springfield by order of Lane County Local Government Boundary Commission under Boundary Commission Final Order Number EC SP 94 - 32 and further described in Attachment 2, and WHEREAS, the property to be withdrawn is located within the boundaries of the Rainbow Water District, and WHEREAS, the City of Springfield City Council held a public hearing in the Springfield City Council Chambers on March 6, 1995 in accordance with ORS 222.524, for the purpose of hearing any objections to the withdrawal of the property mentioned from the public service district mentioned and there having been ~ objections raised, and WHEREAS, the withdrawal ordinance must be submitted to the Oregon Department of Revenue on or before March 31, 1995 in order to become effective on July 1, 1995. NOW THEREFORE THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: The Council of the City of Springfield does hereby determine that the real property described should be in the best interest of the City of Springfield withdrawn from the Rainbow Water District in Lane County, Oregon, insofar as the property are located therein. Section 2: The Common Council of the City of Springfield does hereby determine that the following described real property within the boundaries of the Rainbow Water District are and shall be upon the effective date of this ordinance withdrawn from the Rainbow Water District in Lane County, Oregon, said property being described as follows: Township 17 South, Range 3 West, Section 15, part of Tax Lots 1118, 2800. 2900. 3000 and 3100; as more particularly described in Exhibit A of Attachment 2 of this ordinance, Boundary Commission Final Order No. EC SP 94 - 32. Section 3: It is determined by the Common Council that matters pertaining to the withdrawal affect the public health, safety and welfare and that an emergency exists and this ordinance shall become effective upon adoption by the Council and approval by the Mayor. C-<.9 LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION FROM: SUBJECT: EC SP 94 - 52 (Expedited Procedure) ANNEXATION OF TERRITORY 'TO THE CITY OF SPRINGFIELD (Game Farm Road) By this correspondence, let it be known that: 1. A petition for annexation of territory to the City of Springfield, located in northwest Springfield, including East Game Farm Road right-of-way and public utility easements east of 1-5 and west ofInternational Way (TI7S R03W S 15 parts of tax lots 1118, 2800, 2900, 3000, and 3100), was filed on July 28, 1994, with the Lane County Local Government Boundary Commission in accordance with ORS 199.466 and ORS 199.490(l)(c). 2. An analysis was prepared by the boundary commission staff with a recommendation of approval and sent to the Lane boundary commission members, Lane County commissioners, Lane County Land Management Division, Lane County Environmental Health Division, City of Springfield, Willakenzie Rural Fire Protection District, Rainbow Water District, i'1ike McMahan of Wood Products Credit Union, Thomas Costabile of Sony Disc Manufacturing, Sycan B Corporation, Jeff Cole, Terry and Elizabeth Leo, Michael Miller and Donald and Karen Allread. 3. No request for public hearing was received by 5:00 p.m., August 22, 1994. 4. This annexation proposal, described in attached Exhibit A and shown on attached map Exhibit B, is hereby approved and effective August 22, 1994. Please acknowledge receipt of this correspondence. NOTE: In accordance with ORS 199.51O(2)(a), thc portions of this annexation within the Willakenzie Rural Firc Protection District will be withdrawn automatically from that district upon the effective date of the annexation. Thc portions of this anncxation within the Rainbow Watcr District and will be withdrawn through scparate proceedings by the City of Springfield in accordancc with ORS 222.
