ORDINANCE NG. 5776 (Special) N ORDINANCE WITHDRAWING CERTAIN REAL J:3~bPERTY LOCATED IN NORTH SPRINGFIELD EAST OF 1-5', NORTH OF BEL TUNE ROAD AND WEST OF BALDY VIEW DRIVE; (17S R03W S15 PORTIONS OFRARCELS 700, 2900, 3000, 3100, 3,200, 3400, 3500 AND 3600); HERETOFORE ANNEXED TO THE CITY OF SPRINGFIELD FROM THE RAINBOW WATER DISTRICT AND DECLARING AN EMERGENCY. . WHEREAS, certain real property (International Way) described below was annexed to the City of Springfield by order of Lane County Local Government Boundary Commission under Boundary Commission Final Order Number EC SP 94 - 38 and further described in Attachment 2, and . WHEREAS, the property to be withdrawn is located within the boundaries of the Rainbow Water . District, and WHEREAS, the City of Springfield City Council held a public hearing in the Springfield City Council Chambers on March 6, 1995 in accordance with ORS 222.524, for the purpose of hearing any objections to the withdrawal of the property mentioned from the public service district mentioned and there having been ~ objections raised, and WHEREAS, the withdrawal ordinance must be submitted to the Oregon Department of Revenue on or before March 31, 1995 in order to become effective on July 1, 1995. NOW THEREFORE THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: The Council of the City of Springfield does hereby determine that the real property described should be in the best interest of the City of Springfield withdrawn from the Rainbow Water District in Lane County, Oregon, insofar as the property are located therein. . Section 2: The Common Council of the City of Springfield does hereby determine that the following described real property within the boundaries of the Rainbow Water District are and shall be upon the effective date of this ordinance withdrawn from the Rainbow Water District in Lane County, Oregon, said property being described as follows: Township 17 South, Range 3 West, Section 15, part of Tax Lots 700, 2900, 3000, 3100, 3200, 3400,3500 and 3600; as more particularly described in Exhibit A of Attachment 2 of this ordinance, Boundary Commission Final Order No. EC SP 94 - 38. Section 3: It is determined by the Common Council that matters pertaining to the withdrawal affect the public health, safety and welfare and that an emergency exists and this ordinance shall become effective upon adoption by the Council and approval by the Mayor. OF By this correspondence, let it be known that: 1. A petition for annexation of territory to the City, of Springfield, located in northwest Springfield, north of East <;Jame Farm Road and Deadmond Ferry Road, south of the r..!cKenzie River, east of Sports Way (T17S R03W S14 parts of tax lots 700, 2900, 3000, 3100, 3200, 3201, 3400, 3500 and 3600), was filed on May 12, 1994, with the Lane County Local Government Boundary Corninission in accordance with ORS 199.466 and ORS 199.490(1)(c). 2. An analysis was prepared by the boundary commission staff with a recommendation of approval and sent to the Lane boundary commission members, Lane County commissioners, Lane County Land Management Division, Lane County Environmental Health Division, City of Springfield, Willakenzie Rural Fire Protection District, Harold and Leona Rice, G. H. and Colleen Froerr,uning, Eric and Dorcas Wicklund, Badil Faris, Sycan B Corporation, Jeff Cole, Terry and Elizabeth Leo, Michael Miller, and Donald and Karen Allred. 3. No public hearing request was received by 5:00 p.m., June 20, 1994. 4. This annexation proposal, described in attached Exhibit A and shown on attached map Exhibit B, is hereby approved and effective June 20, 1994. Please acknowledge receipt of this correspondence.
