ORDINANCE NO. 5768 AN ORDINANCE ADDING ARTICLE 23, "LIQUOR LICENSE RECOMMENDATION", CHAPTER VIII, "BUSINESS LICENSES" OF THE SPRINGFIELD CODE PERTAINING TO THE FEE FOR THE PROCESSING OF A RECOMMENDATION REGARDING A LIQUOR LICENSE TO THE OREGON LIQUOR CONTROL COMMISSION AND STANDARDS FOR THE RECOMMENDATION OF DENIAL, AND DECLARING AN EMERGENCY. CITY OF SPRINGFIELD, OREGON DOES ORDAIN AS FOLLOWS: SECTION 1. There is hereby added to Chapter VIII "Business Licenses" Article 23 "Liquor License Recommendation" of the Springfield Code including the following sections: "Article 23 Liquor License Recommendation. 8-23-1 Recommendation Required. The Oregon Liquor Control Commission requires of every Applicant for a license to sell spirits, wines, beers, and other alcoholic liquors a Recommendation in writing of the City Council. 8-23-2 Processing Fee. At the time of any license application, change in ownership or change in location, or change in privilege application, or renewal or temporary application, the applicant shall pay to the city of Springfield for processing such license application the following applicable fee: (a) (b) (c) Initial original application: Change in ownership, change in location, change in privilege application: Renewal or temporary application: $100.00 or 75.00 35.00 8-23-3 Council Action. (1) The Council shall provide a written recommendation for each applicant. The Council may recommend denial of the license based upon reliable, factual information related to any of the following criteria: (a) Disturbances, lewd or unlawful activities or noise in or on the immediate vicinity or the premises that are related to the sale or service of alcoholic beverages. (b) Applicant ha~ a history or arrest record of alcohol abuse or other co~trolled substance use. (c) The licensed premises has a history of serious or persistent problems with unlawful activities, noise or disturbances resulting in the need to provide extraordinary police or other city services. . . . .- (d) Applicant proposes to locate near a licensed child care facility or elementary or secondary school; a church; a hospital, nursing care facility or convalescent care facility; a park or child oriented recreational facility; an alcohol or other drug treatment or rehabilitation facility. (e) Applicant fails to provide complete information on city application. (f) Applicant provides false or misleading information." (2) Prior to each annual liquor license renewal period, the City Council shall hold a public hearing to allow interested persons the opportunity to provide testimony to be considered by the City Council in making their decision to recommend approval or denial of any specific renewal applications. Notice of this public hearing shall be advertised in a local newspaper at least 4 days before the hearing. This requirement applies to renewal applications and does not apply to original, change in ownership, location 6r privilege applications.~ SECTION 2: It is hereby found and determined by the Common Council that matters pertaining to the processing of liquor licenses are matters affecting the public, health, safety, and welfare, and that an emergency therefore exists, and that this ordinance shall therefore take effect immediately upon its passage by the Council and approval by the Mayor.
