ORDINANCE NO. 5767
AN ORDINANCE VACATING A 3,818 SQUARE FOOT PORTION OF A CUL-DE-SAC
BULB LOCATED AT THE WESTERN TERMINUS OF COLONIAL DRIVE, LANE COUNTY.
WHEREAS, the Springfield City Council has declared its intention to vacate a 3,818
square portion of right of way located within the City of Springfield; and
WHEREAS, such vacation is in the best interest of the City in carrying out its plans and
programs for the general development of the City; and
WHEREAS, lawful notice of the proposed vacation was published and posted; and
WHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth Street,
on Monday, the 21st day of November, 1994, at the hour of 7:00 p.m., to hear any
objections to the proposed vacation and ~ persons appeared to object;
NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS:
Section 1: The Council finds that the legal notice of the hearing was lawfully published
and posted; that ~ objections were made at the vacation hearing held; that the public
interest will not be impaired by the vacation of this public right of way, and that vacation of
said right of way will be in the best interest of the public and increase the benefit of the
property involved.
Section 2: The following described portion of right of way to be vacated:
Beginning at a Initial Point of Land Partition Plat Number 90-PO 178, said Initial Point being the
point of intersection of the southerly margin of Colonial Drive with the west margin of said
Colonial Drive and thence running along said west margin North 00 07' 45" West 45 feet to
the point of intersection of said west margin with the northerly margin of said Colonial Drive;
thence leaving said west margin and running along said northerly margin North 890 57' 40"
East 20.69 feet and along the arc of a 40.00 foot radius curve right (the long chord of which
bears North 740 22' 43" East 18.50 feet) 18.67 feet; thence leaving said northerly margin
and running South 00 02' 20" East 24.97 feet to a point on the centerline of said Colonial
Drive; thence running along said centerline North 890 57' 40" East 15.64 feet; thence leaving
said centerline and running along the arc of a 50.00 foot radius curve left (the long chord of
which bears South 250 05' 15" East 42.33 feet) 43.71 feet; thence along the arc of a 20.00
foot radius curve right (the long chord of which bears South 490 35' 23" East 0.37 feet) 0.37
feet to a point on said southerly margin of Colonial Drive; thence running along said southerly
margin along the arc of a 40.00 foot radius curve right (the long chord of which bears North
790 12' 23" West 72.32 feet) 90.32 feet and South 890 57' 40" West 1.25 feet to the Point
of Beginning, all in Springfield, Lane County, Oregon.
Section 3: The findings in the attached staff report (Jo. No. 94-10-195) are hereby
made part of this ordinance by reference.

Section 4: The City Recorder is directed to file the certified copies of this ordinance
with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor.
ADOPTED by the Common Council of the City of Springfield this 21 st day of
November, 1994, by a vote of 2- for and ~ against.
APPROVED by the Mayor of the City of Springfield this 21 st day of November, 1994.
