508.3 Mixed occupancies. Each portion of a building shall be
individually classified in accordance with Section 302.1.
Where a building contains more than one occupancy group.
the building or portion thereof shall comply with Sections
508.3.1.508.3.2.508.3.3 or a combination of these sections.
Exceptions:
I. Occupancies separated in accordance with Section
509.
2. Where required by Table 415.3.2, areas of Group
H-l. H - 2 or H - 3 occupancies shall be located in a sep-
arate and detached building or structure.
508.3.1 Accessory occupancies. Accessory occupancies
are those occupancies subsidiary to the main occupancy of
the building or portion thereof. Aggregate accessory occu-
pancies shall not occupy more than 10 percent of the area of
the story in which they are located and shall not exceed the
tabular values in Table 503,. without height and area
increases in accordance with Sections 504 and 506 for such
accessory occupancies.
Exceptions:
I. Accessory assembly areas having a floor area less
than 750 square feet (69.7 m') are not considered
separate occupancies.
2. Assembly areas that are accessory to Group E
occupancies are not considered separate occupan-
cies except when applying the assembly occu-
pancy requirements of Chapter II.
GENERAL BUILDING HEIGHTS AND AREAS
3. Accessory religious educational rooms and reli-
gious auditoriums with occupant loads of less than
100 are not considered separate occupancies.
508.3.1.1 Occupancy classification. Accessory occu-
pancies shall be individually classified in accordance
with Section 302.1. Code requirements shall apply to
each portion of the building based on the occupancy clas-
sification of that accessory space. except" that the most
restrictive applicable provisions of Section 403 and
Chapter 9 shall apply to the entire building or portion
thereof.
508.3.1.2 Allowable area and height. The allowable
area and height of the building shall be based nn the
allowable area and height for the main occupancy in
accordance with Section 503.1. The height of any acces-
sory occupancy shall not exceed the tabular values in
Table 503, without height and area increases in accor-
dance with Sections 504 and 506 for such accessory
occupancies.
508.3.1.3 Separation. No separation is required
between accessory occupancies or the main occupancy.
Exception: Group H-2. H-3, H-4 or H-5 occupancies
shall be separated from all other occupancies in accor-
dance with Section 508.3.3.
508.3.2 Nonseparated occupancies. Buildings or portions
of buildings that comply with the provisions of this section
shall qualify as nonseparated occupancies.
508.3.2.1 Occupancy classification. Nonseparated
occupancies shall be individually classified in accor-
dance with Section 302.1. Code requirements shall apply

308.3.1 Child care facility. A child care facility thaI provides
care on a 24-hour basis 10 more than five children 2'/, years of
age or less shall be classified as Group 1-2.

2'/2 years old and younger on a 24-hour basis are clas-
sified as Group 1-2 because children that age are not
generally capable of responding to an emergency and
must be led or carried to safety. Under such circum-
stances, the OCCupants are considered nonambula_
tory. The distinguishing factor between Groups 1-2 and
1-4 is the amount of time the facility provides care;
Group 1-2 facilities provide care on a 24-hour basis.

is also assumed that medical Supervision is present in
Group 1-2 facilities. Figure 308.3.1 summarizes the dif-
ferent occupancy classifications for care facilities.
308.4 Group 1-3. This OCcupancy shall include buildings and
slructures that are inhabited by more than five persons who are
under restraint or security. An 1-3 facilily is occupied by per-
sons who are generally incapable of self-preservalion due to
security measures not under the occupants' conlrol. This group

Detention centers
Correctional centers
Prerelease centers

BUildings that have these characteristics but th
contain an OCCUpant load of five or less are classifie
as a residential occupancy, but are still subject to sp
cial hardware requirements (see Chapter 10).
It is recognized that not all Group 1-3 occupancie
exercise the same level of restraint; thus, to distin
guish these different levels, the code defines five dif
ferent COnditions of OCcupancy based on the degree 0
access to the exit discharge.
The five occupancy conditions are summarized in
Figure 308.4.

308.4.1 Condition I. This OCcupancy condilion shall includ~
buildings in which free movement is allOwed from sleeping'
areas, and other spaces where access or OCcupancy is permit~

such, a key or remote control release device is not
needed for any OCCUpant to reach the exterior of the
building (exit diScharge) at any time. These types of
buildings are referred to as low-security facilities. A
work-release center is a typical Condition 1 facility
(see Figure 308.4.1).

are intended to be used for less than 24 hours and are
not intended to provide medical supervision. Day care
facilities are not intended to be a residence for the peo-
pie receiving care. The'staff members are assumed to'

ties. In order to be consistent,with the other Group I fa-
cililies, buildings.that have five or less occupants are to
be classified as Group R-3, or shall be constructed in
accordance with the IRC. The definition for Group 1-4
facilities could be construed to include places of wor-
ship; therefore, the last sentence of Section 308.5 clar-
ifies thaI Group 1-4 provisions would not appiy to
places of worship unless the space is also used for day
care facilities.

Mercantile buildings most often have both a moderate
occupant load and a high fuel load, which IS In the form
of furnishings and the goods being displayed. stored
and sold [see Figure 309.1 (1 )J.. .
The key characteristics that differentiate occupan-
cies classified in Group M from those classified In
Group B (see Section 304) are the larger quantity of
goods or merchandise available for sale and the lack
offamiliarity oflhe occupants With the bUlldmg, particu-
larly its means of egress. To be claSSified In Group M,
the goods that are on display must be accessible t~ the
public. If a patron sees an item for sale, then that Item
is'generally available for purchase at that time (I.e.,
there is a large stock of goods). If a store allows people
t see the merchandise but it is not available on the
:remises. such as 'an automobile showroom, then the
occupancy classification of bUSiness (Group B) should
be considered, A mercantile bUilding IS accessible to
the public, many of whom may not be regular vIsitors.
A business building, however. IS pnmarlly occupied by
regular employees who are. familiar with the bUilding
arrangement and, most importantly... the eXits. ThiS
awareness of the building and the eXits can be an Im-
portant factor in a fire emergency, .
Automotive, fleet-vehicle, marine and self-service
fuel-dispensing facilities, as defined In the'IFC, are
classified in the mercantile occupancy, as are the con-
venience stores often associat~d wllh such occupan_
cies [(see Figure 309.1 (2)]. QUick-lube, tune-up, muf-
fler and tire shops are nol included In thiS
classification, Those facilities that tYPically conduct
automotive service and repair work are treated as a re-
pair garage (Group S-1, also defined in the IFC).
