Located at 6444 and 648~Main ~ Dear Mr. Travess, Staff Decision: Preliminary Approval ~ith conditions - see Page 3. Findings of Fact Request The request is for a Lot Line Adjustment to add 11,000 square feet of Tax Lot 4300 to Tax Lot 4301; Assessor's Map# 17-02-34-42 (6380 Main Street). Background Mr. Travess o~ns both Tax Lots 4300 and 4301. The lot lines apparently ~ere adjusted by a previous purchaser of the property ~ithout approval from the City. This request ~ill allo~ Tax Lot 4301 to be similar in configuration to ~hat actually existed several years ago. In addition, the drive~ay ~hich serves the structures on Tax Lot 4301 ~ill be fully included on this lot giving these structures direct access to Main Street. Criteria of Approval (Ref. Section 33.040 of the Springfield Development Code) The Lot Line Adjustment does not: 1. Create a nev lot or land-locked parcel; No ne~ lot or land-locked parcel is proposed to be created. . . Reduce an existing lot below the mInImum dimensions applicable zoning district or otherwise violate the Development Code, or Structural Specialty and standards; established by the standards of the Springfield Fire and Life Safety Code Tax Lot 4301 currently contains 12,782 square feet. Tax Lot 4300 currently contains 74,303 square feet. Upon approval of this request, Tax Lot 4301 will contain 23,800 square feet and have 85 feet of frontage on Main Street; Tax Lot 4300 will contain 58,300 square feet and have 99.8 feet of street frontage. The minimum lot size in the LDR District is 4,500 square feet with 45 feet of street frontage. Both of these lots will exceed these standards. The property is zoned Low Density Residential; the Metro Plan Designation is, Low Density Residential. There are two structures on Tax Lot 4301. Two structures on one LDR property is a non-conforming use (if one structure is destroyed, it cannot be rebuilt). No expansion of a non-conforming use will occur because of this Lot Line Adjustment reques t. The frame shed shown on the Lot Line Adjustment diagram must either be moved, or the lot line moved so that there is a three foot setback between the shed and the new property line, or the shed must be removed from the property. Local streets do not appear on the TransPlan. However, this Type I application will trigger the dedication of right-of-way (30 feet from centerline on North A Street) and an Improvement Agreement for North A Street. This request will not impede the implementation of adopted transportation or public facilities plans. 4. Violate any previous requirements or conditions the Approval Authority may have imposed at a prior public hearing or meeting. Decision Since the request complies with the criteria of approval, as conditioned, the proposed Lot Line Adjustme~t will be granted Preliminary Approval. .. . . ./ Page 3 Travess LLA The Springfield Development Code requires that a surveyor be hired to set new property pins and create new legal descriptions. The map submitted shows pins set. Please send a copy of the new legal descriptions to my attention. Vhen the conditions listed below have been met, Final Approval will be granted. Conditions Submittal of: 1. Two copies of a survey showing the three foot setback between the shed and the new property line or that the shed has been removed. 2. Therefore, you should request that the Lane County Department of Assessment and Taxation combine the property being transferred into the same tax lot as the recipient lot.
