I'm writing with regard to a letter of intent recently received from you relative to the operation of a weapons dealership at your residence lo- cated at 6112 Main Street #5, Springfield, Oregon. As you know, a com- mercial business is not a permitted use in a residential zone. Home occupations, however, are permitted in a residential zone. Enclosed is a copy of the definition and limitations of a home occupation as specified in the Springfield Comprehensive Zoning Code. Your proposed weapons dealership must conform to the requirements of said definition. In your letter, you state that a federal regulation requires you to post business hours. The Springfield Zoning Code allows a "nameplate"- i.e. name of business only, to be posted. It is not the intent of the Springfield Zoning Code to allow a home occupation to establish specific commercial business hours thereby receiving customers and creating a potential traffic problem or conditions that are not conducive to the residential nature of the area. While we are not asking you to ignore a federal regulation that requires you to post business hours, we are requesting that you not permit the operation to exceed the limitations of a home occupation as defined in the Zoning Code. Perhaps a supple- mental letter to this effect from you would also be appropriate at this time. Please direct all inquiries to the Springfield Building Division at 726-3753. It is not my intent to establish specific com- mercial business hours, thereby receiving customers and creating a potential traffic problem or conditions that are not conductive to the residential nature of the area; but only to comply with Federal regulations of having specific hours of operations posted under the name plate of business. I will have a P.O. Box at the Post Office for handling mail orders so my address will not be made readily available to general public. I will a1s01be displaying and.trading at local gun shows during weekends. I will comply with the city code as to a name plate on the door no bigger than 17, sq. ft. which must include, by federal regulation, posted hours of operation which will be Monday-thru-Friday: 6:00 P.M. to 10:00 P.M. under my name.
