Subject: Property Located at 5848 Main Street, Springfield, Oregon
Dear Mr. and Mrs. Large:
A complaint was received and reviewed by the City of Springfield.
The property the complaint was regarding is 5848 Main Street, Asses-
sor's Map 17-02-34-32 Tax Lot 00300.
The complaint was regarding the use of this building and it's relation-
ship to the RP zoning that was approved some years back. In reviewing
the City's records for this property it was discovered that the property
.did, at one time, have Residential-Professional (RP) zoning. However,
the City Council discontinued the RP zoning district in 1986 and all
properties which were zoned RP in the past reverted to their original
zoning.
In the case of this property the. zoning is now Low Density Residential
(LDR). Residential-professional uses which were legally established
under the original RP zoning are permitted to continue in accordance
with Article 5 NON-CONFORMING USES of the Springfield Development
Code. All uses which continue must also be in conformance with the
uses permitted in the use list. The permitted uses list is very
specific and includes the following: accountants, architects, attorneys,..
computer programmers, engineers, insurance agencies, medical and dental
practitioners, planners, realtors and studios for artists, interior
decorators and photographers.
Properties which were zoned RP and never developed those properties
through the site plan and building permit processes can not develop
the properties with RP uSeS unless they meet the newly adopted standards
in Article 16. One of the standards is that the property must abut
commercially zoned/designated property. The property at 5848 Main
Street does not abut commercially zoned/designated property. The
only way for it to be used for an RP use is i~ it received valid
permits and was developed for an RP use AND the use of the building
as an approvedRP use has not ceased for 90 days or longer.
The complaint the City received was that the use operating from the
building at 5848 Main Street is not one of the uses listed as permitted.
It is my understanding that your business operates from a building
in front of this building at 5846 Main Street and that your business
is on the permitted use list (insurance).

Please contact this office within ten (10) days of the date of this
letter regarding this matter.
I will need verification of the use operating from 5848 Main Street
as well as information that the building received building permits
and was reviewed through the site plan review process to be used for
residential-professional offices.
It is the City's standard practice to inform citizens of a violation
and request.that it be corrected within a reasonable time. In the
event that you have not taken corrective action by the assigned time,
deadline, a civil infraction citation will be issued to the resident/and
or property owner.

situation.

The Springfield Planning Commission
Wednesday pulled the rug out from under a
Springfield man's objections to restrictions
placed on the carpet-cleaning business he
operates out of his Cascade Drive home.
Greg Mott. the city's development code
administrator, said the commission upheld
restrictions placed on Terry Comstock's
Rainbow International Carpet Dyeing and
Cleaning Company. Planning director Greg
Winterowd agreed to grant Comstock a home
occupation permit for 501 Cascade Drive, but
only if he agreed to limit the number of
business vehicles permitted at the residence
to one at any given time and forgo on-site
cleaning of company equipment_
Comstock appealed Winterowd's decision
to the commission, which held a 2y,-hour
public hearing on the matter Wednesday.
Mott said five neighbors testified against
the propriety of having the business in their

submitted letters of concern, he said.
Comstock argued :. that .Winterowd had
erred In prohibitin'g ':. the.' company from
dispatching vehicles horn the house. on the
basic that his busines;;"traffic is minimal. He
also maintainedthabitiy equipment cleaning
is done inside the house and has no effect on
the neighbors. .
After the meeting. 'Comstock said he ob-
jected as well to the fact that commissioners
were given a history of complaints from a
previous business location in the packet they
used to decide this appeal.
Comstock also contended that with all the
vacant lots in his'. neighborhood, only one
neighbor can even see what goes on at 501
Cascade Drive. .. .'
The commission's 'decision to uphold
Winterowd's conditions was unanimous.
Comstock said Friday that he would not
spend the $300 required .foran appeal to the
city council, .but he insisted that his business
could continue to operate..

In particular. Comstock noted that since he
opened an office at 5848 Main St. 10 days ago,
in his opinion that eliminates the need to get
a home occupation permit.
"If they cite me," Comstock told the News,
"then excuse me for saying it, but they can
go straight to hell."
In other business Wednesday the com-
mission took a first look at a proposed or-
dinance to allow mobile homes as hardship
residences in case of medical or housing
emergencies.
Mott said the commission addressed the
ordinance itself only briefly in its one-hour
work session. Instead. he said the com-
missioners focused on the larger issue of
whether the city should permit a wider range
of housing alternatives for incapacitated
relatives.
As a result of its discusson, the commission
took no action on the ordinance request.
Instead. it decided to ask the city council to
appoint a task force to look into the broader
issue.
