MEMORANDUM CITY OF SPRINGFIELD April 27, 1989 FROM: Bob Murray, Electrical Inspector * ,) TO: Dave Puent, Building Official SUBJECT: Inspection Report for 5803 Main Street On April 20, 1989 I received a referral for an electrical inspection from Dick Evenson, Deputy Fire Marshall, of the Springfield Fire Department. Mr. Evenson stated he was cleaning out his files and came across a referral for an electrical inspection at 5803 Main Street, Springfield, Oregon. Mr. Evenson commented the referral date was May 18, 1988. Since the referral is a year old, he was wondering if any action had been taken and if I could follow-up for him. I said I would when time allowed. On April 21, 1989, I researched our files in an effort to obtain any available information regarding this inspection referral. I found no indication that any inspection had been performed. On April 24, 1989, I proceeded to 5803 Main Street to inspect the electrical service equipment in question. I arrived at about 3:30 p.m. and noted the building housed a restaurant. I entered through a door on the west side of the building and proceeded to the corner of the service counter nearest me. With only one customer at the counter, and one at the drive-up window and three employees, my wait at the counter was brief. An employee asked if she could help me. At this point, I identified myself to her and asked to speak with the store manager. She informed me the store manager was not there, but the assistant manager would be available in a moment. I waited a few minutes at the corner of the counter. While I waited, I notice a cupboard across the restaurant from my location with a name plate reading "Breakers Inside". An employee approached me, identified. herself as the assistant manager, and asked me if she could assist me. I identified myself by name, title and employer. At this point I also gave her my business card and displayed a copy of the referral I was given by Mr. Evenson of the fire department. I asked if I could inspect the panel in question. She guided me to the cupboard I had noticed earlier. She removed a number of cups from a shelf in front of the cupboard doors. Having removed the cups, she then opened the upper and lower doors. This revealed the electrical service equipment inside. ,I thanked the assistant manager and returned to the corner of the counter where I originally had been waiting. . . At that point, I informed the assistant manager that the service equipment was in a concealed space or closet, and was violation of the State of Oregon Electrical Safety Law. I informed her the doors would have to be removed, and asked if she was the correct person that needed this information. She said she correct person. Also attached is a copy of the fi~e depa~tment ~efe~~al that was given to Bob, a copy of the Elect~ical Safety Law, Article 230-70 (A) providing standa~ds fo~ the installation of elect~ical se~vice equipment and Section 201. (C) of the Building Safety Code Administ~ative Code which p~ovides the Building Official autho~ity to ente~ a building whe~e reasonable cause exists to believe a violation may exist to make a p~emise unsafe o~ haza~dous. The following info~mation ~esponds to seve~al of the items add~essed by M~. Ma~k Steele, Manage~ of Bob's Restaurant, ~elati.ve to the inspection p~ocedu~e on Ap~i.l 24, 1989. 1. We have no ~eco~d of the fi~e depa~tment ~efe~~al being ~efe~~ed to us in 1988. It is notewo~thy that fo~ seve~al months around this pe~iod of time the City did not have the se~vices of an elect~ical inspecto~ fo~ anything othe~ than ~egular pe~mit inspection ~equests. 2. The fi~e depa~tment conducts a yea~ly inspection of all businesses located within the City. When, in thei~ eyes, a potential haza~d may exist, the no~mal policy is to ~efe~ an inspection ~equest to the Building Safety Division. 3. The inspection ~efe~~al notes "~emodel wo~k has put panel in concealed location". We have no ~eco~d of building pe~mits being issued o~ inspections being conducted afte~ the Ce~tificate of Occupancy was obtained in 1981. 4. Although the ~efe~~al was almost a yea~ old, we have no ~eco~d of the assumed safety violation being co~~ected. 5. The se~vice equipment (cupboa~d) and not in ~equi~ed by State law. is in a concealed location a "~eadily accessible location" . . 6. The labeling of a concealed location by itself, is not an approved alternative to the applicable section of the Electrical Safety Law. In addition, fire department personnel are not certif.ied as electrical inspectors. 7. In reviewing Bob's memorandum and in several subsequent conversations with Bob, it appears that proper inspection procedure and professionalism was utilized in the inspection he performed. Bob has been this period, the community courteous and responsibilities. employed with the City for almost one I have never observed or received any where Bob has not responded in a friendly manner in performing year.
