RESOLUTION
No. 09-15
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD
ADOPTING AN INMATE HOUSING FEE.
WHEREAS, Oregon law provides two methods by which persons who have been
convicted are housed in a corrections facility may be charged for their housing costs;

WHEREAS, under ORS 161-:f-5e{ft cities are allowed to charge actual costs or up to
$60.00 per day whichever is less and request recovery of this charge through a civil suit filed
within one year of the inmate being released;
WHEREAS, ORS 137.540(1) authorizes sentencing courts to impose jail costs as a
general condition of probation;
WHEREAS, the City of Springfield, pursuant to an intergovernmental agreement,
currently pays $109.00 per day for up to five inmates housed at the Lane County Adult
Corrections facility;
WHEREAS, the City of Springfield Municipal Jail is set to open late 2009 at which time
the City will be directly incurring the cost of housing its municipal inmates.
NOW THEREFORE, be it resolved by the Common Council of the City of Springfield enacts
an inmate housing fee ordinance as follows:
1) The inmate housing fee is $60.00 per day after conviction for each night the inmate is
housed in either the Lane County Adult Corrections Facility under the Intergovernmental
Agreement or Springfield Municipal Jail.
2) The fee may be imposed at sentencing during the criminal proceeding or by a civil suit
brought in Lane County Circuit Court or Springfield Municipal Court depending on which process
results in the greatest recovery for the City.
3) This Resolution shall take effect on the 20th
April
of
, 2009.
This Resolution adopted by the Common Council of the City of Springfield this 20th day of
