ORDINANCE 5757 (General) AN ORDINANCE AMENDING SECTION 8-6-15, 8-6-16, 8-6-17 AND 8-6-18, ARTICLE 6, CHAPTER VIII OF THE SPRINGFIELD CODE PERTAINING TO THE OPERATION OF SHOOTING AREAS. , THE CITY OF SPRINGFIELD, OREGON DOES ORDAIN AS FOLLOWS: SECTION 1. section 8-6-15, Article 6, Chapter VIII of the springfield Code is hereby amended as follows: "8-6-15 Shooting Areas--General. It shall be unlawful to establish, maintain or operate any shooting area within the City unless a license for that use is obtained from the city. Every place or building where firearms as defined in section 5-11-1 are used for shooting, whether for hire or not, shall be deemed a shooting area subject to the provisions of this section." SECTION 2. section 8-6-16, Article 6, Chapter VIII of the Springfield Code is hereby amended as follows: "8-6-16 Shootinq Areas--Business License. An applicant for a shooting area business license shall apply to the Development Services' Department prior to opening a shooting area facility. The following conditions of operation shall apply to the issuance of the shooting area business license: (1) The site must be zoned with a classification that allows such a use; (2) The applicant shall be the owner, lessee or person lawfully in possession of the premises; (3) Operators and employees shall have no convictions which would prohibit them from obtaining a Federal firearms dealer's license and they shall have no felony convictions within the past 5 years or no Class A misdemeanor convictions within the past 3 years; (4) Hours of operation of the shooting area shall be limited to the following times: 10:00 a.m. to 10:00 p.m., except other times may be permitted upon good cause shown; (5) site Plan Review procedures of Article 31 and any other applicable standards specified in the Springfield Development Code shall be met; (6) The discharge of firearms in such area will not jeopardize life or property. t:: . (7) Buildings shall be designed for the heaviest ammunition that might be used on the range as specified in the "Range Manual" prepared by the National Rifle Association and/or "Model Range Code for Gallery Shooting Ranges" prepared by Caswell International Corporation or other similar document as may be approved by the Building Official and the Fire Marshall. Special attention shall be given to ventilation systems, lighting, safety baffles and backstop configuration. The' following conditions of operation shall apply: (a) Armor piercing and incendiary ammunition is prohibited; (b) Operation of the shooting area shall cause not more than 40 db of noise at the outside building wall (as determined by a qualified acoustical consultant prior to construction); (c) The storage of gunpowder, ammunition and primers shall be in accordance with the Uniform Fire Code; (d) The operator shall ensure that all firearms are inspected to determine that the weapons are unloaded prior to leaving the firing area; and (e) The type of firearm and propellant for each Shooting area shall be specified. . (8) Compliance with the conditions specified in Subsection (4) shall be determined by the Building Official and Fire Marshall from plans provided for construction and site Plan Review prior to Obtaining the building permit. Upon compliance, issuance of the business license will occur. The business license shall be posted at the shooting area and available for inspection. The license is to be obtained'before occupancy approval request. (9) The shooting area business license fee shall be $100.00. The license shall be granted for a period of one year and shall be renewed on a yearly basis." (10) The operation shall post two signs clearly visible to the public not less than 8 1/2 by 11 in. in size stating as follows: "The firearms used on these premises shall not be discharged within the city of springfield except in shooting areas licensed by the City." SECTION 3. Section 8-6-17, Article 6, Chapter VIII of the Springfield Code is hereby amended as follows: . "8-6-17 Shootinq Areas. Any shooting area business license shall be subject to revocation by city staff, including, but not limited to police, fire, building safety or code enforcement, if the shooting area is found to be in . . . < ' .t. violation of the conditions under which the business license was issued. The revocation decision may be appealed to the City Councilor its designee. The City Council reserves the right, in its discretion, to uphold the revocation or refuse to allow future shooting area business licenses to be issued until the Council is satisfied that the conditions specified in Section 8-6-16 have been met... SECTION 4. section 8-6-18, Article 6, Chapter VIII of the Springfield Code is hereby amended as follows: "8-6-18. Shootinq Areas--Business License--Exemptions. Except for compliance with applicable procedures of the Springfield Code, City operated shooting areas shall be exempt from business license requirements specified in section 8-6-15 through 8-6-17 of this Chapter. Unenclosed shooting ranges shall be permitted only in the Booth Kelly Mixed Use District and shall be operated by the city."
