A council briefing memorandum was prepared July 15,2008 asking the City Council to
authorize the City Manager to sign an annexation application for the Martin Luther King Jr.
Parkway to become City right-of-way and for the City of Springfield to provide maintenance to
those streets.
This action led to Resolution No. 08-36, adopted by Council and signed by the Mayor on July
21,2008. Since that time a Development Issues Meeting (DIM) was held on Dec. 18th, 2008,
case number ZON2008-00041, whereby Staff began discussion of the annexation process. Staff
is now prepared to initiate the pre-submittal application.
Accompanying this memo is the annexation pre-submittal application for yom review and
signature. Your signature is required as the duly authorized representative oqhe City of
Springfield. After you have signed the application, it will be officially submitted and reviewed
for completeness.
Comments returned by City Staff will be addressed and the items required for the annexation
application to be deemed complete will be included in the final submittaL When the second
submittal (final application) is submitted, the public notice phase will be initiated. Just for your
information, you will be required to sign the second completed application form as welL

The annexation of these various parcels is being initiated to bring property owned by the City of
Springfield into the jurisdiction ofthe City. It is currently under the jurisdiction,ofLane County.
Addressing specific criteria as required by code SDCS.7-12S(B) (13) and (14):
A. The affected territory is within the current UGB and is contiguous to the'city limits
B. The proposed annexation is in fact consistent with applicable policies in,the Metro Plan
and any refinemeni districts. .
C. All urban services have been constructed and the right of way has been fully improved to
meet the requirement of providing minimum levels of key urban services.
D. There arb no fiscal impacts to the City and an annexation agreement is not required. This
is a council initiated action.

investigate and track accident reports. Also, any citations issued1would 'be processed
. through Municipal Court rather than Lane County Court.
The annexati()o of the rights-of-way for this project may create islands of un-
annexed County land within the City limits. The City has no recent histol)' of
unilateral annexations and there are 00 plans for unilaterally annexing any of that
territol)', but State law gives the CitY the authoritY to do so. I, .
With the exception of public staff time dedicated to the annexation process, there are.
no other significant financial impacts associated with the initiation by Council
Resolution. If initiated, the proposed annexation ordinance would be scheduled to
come before the City Council at a public hearing on or about October 6, 2008.. A
second reading and adoption of a proposed ordinance annexing the subject area
'could occur on or about November 3, 2008. .

ISSUE
The City Manager requ~sts City Council authority to sign the application for annexation for.
lands associated with the Martin Luther King, Jr. Parkway, as a part of completing the new
arterial link and assuming responsibility from Lane County.
BACKGROUND
In February 2003, the City of Springfield and Lane County executed an Intergovernmental
A&......=ent (lGA) for the use of Lane County Community Development Road rmproveme~t
Assistance Program (CAP) funds to design and construct the Martin Luther King, Jr.
Parkway. In this agreement, it is stated that the project roadways Will be City streets and that
the City will be responsible for maintenance. In order for the City to assume maintenance
responsibility the City and County agreed the Streets would become City right-of-way and be
annexed into the City limits. Much of the MLK Jr. Parkway right of way is within City limits,
through annexations associated with the PeaceHea1th RiverBend project; however, over half
still needs annexation. In addition, there are segments of Pioneer Parkway East and West,
Hayden Bridge Way at the roundabout and a small portion of the BeltlinelGarne Farm Road
intersection that the City Engineer and County Engineer have agreed should also be
transferred, for a total annexation of 1134 acres.
DISCUSSION
Properties proposed for annexation are limited to street right-of-way and City-owned lands
only. There are no privately owned limds proposed for annexation with this action.
Annexation of these lands may create islands of un-annexed County lands within City limits.
State law gives the City the authority to forcibly annex lands in island within the city limits ,
without the request or consent of the affected property owners. The City of Springfield has no .
plans at this time to forcibly annex these island areas, and has not exercised the authority to
do so in the recent past. It is likely the creation of these islands may cause some concern
among p,vp",~j owners within the islands. City staff intends to send letters to p<vp...,~j

owners within the new islands to explain the City's intention not to annex these.lands without
a request from property owners, or to comply with' statutory requirements concerning
development of land or providing public wastewater service in the event offailed septic
systems.' The letter would also confirm for these property owners that this almexation action
is strictly to create ownership and maintenance consistency with the new City streets. Figure
I shows the islands that will be created by the proposed annexation.

RESOLUTION NO
A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO JHE CITY OF
SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE SPRINGFIELD DEVELOPMENT CODE,
WHEREAS, the City Council is authorized by Section ,5.7-125 of the Springfield Development
Code to initiate annexation of contiguous property to the City Limits of Springfield, and
WHEREAS, the propertY to be annexed is publicly owned property and rights of way of the State
of Oregon, and
WHEREAS, the territory to be annexed is wnhin the Eugene-Springfield Urban Growth Boundary,
is contiguous to the City of Springfield and can be provided with a full range of key urban services
including sanitary sewer, water, storm drainage, police and fire protection, electrical service, land
use contr~ls, street lights ,and paved streets, recreational facilities arid library,
WHEREAS, annexation procedures shall be initiated and followed in accordance with the public
notice and hearing process, criteria of approval and ordinance adoption procedures' coritained in
, Springfield Development Code Section 5,7- Annexations. '
NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: '
Section t: The Common Council of the City of Springfield does hereby announce ns intention to
conduct public hearings to consider annexation of territory generally described as publicly owned
rights of way and public property located between existing City limns at the projected intersection
of T' Street with Pioneer Parkway to the intersection of Game Farm Road with Mallard Avenue as
generally depicted on the attachments Exhibtts 1 and 2.
Section 2. This Resolution shall become effective upon its adoption by the Coundl and approval by
the Mayor. '

RESOLUTION NO 08-36
A R-ESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF
SPRINGFIELD PURSUANT TO SECTION 5,7 OF THE SPRINGFIELD DEVELOPMENT CODE.
WHEREAS, the City Council is authorized by Section 5.7-125 of the Springfield Development
Code to initiate annexation of contiguous property to the City Limits of Springfield, and
WHEREAS, the property to be annexed is publicly owned property and rights of way of the State
. of Oregon, and
WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban ,Growth Boundary,
is contiguous to the City of Springfield and can be provided with a full range elf key urban services
including sanitary sewer, water, storm drainage, police and fire protection, electrical service, land
use controls, street lights and paved streets, recreational facilities and library,
WHEREAS, annexation procedures shall be initiated and followed in accordance with the public
notice and hearing process, criteria of approval and ordinance adoption procedures contained in
Springfield Development Code Section 5.7- Annexations, .
NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS:
Section 1: The Common Council of the City of Springfield does hereby announce its intention to
conduct public hearings to consider annexation of territory generally described as publicly owned
rights of way and public property located between existing City limits at the projected intersection
of"r Street with Pioneer Parkway to the intersection of Game Farm Road with Mallard Avenue as
generally depicted on the attachments Exhibits 1 and2.
Section 2. This Resolution shall become effective upon its adoption by the Council and approval by'
the Mayor.

Summary and explanation of edits required to the MLK Annexation
Description that was submitted to City Council on July 21, 2008 under
the following proposed resolution: A RESOLUTION INITIATING
ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF
SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE
SPRINGFIELD DEVELOPMENT CODE,

Attached is the new legal description for the proposed annexation of street right of ways
consisting of portions of Martin Luther King Jr. Parkway, Game Farm Road, and
Deadmond Ferry Road. The items listed hereon are referenced on this copy of the new
description and also on the attached copies of the exhibit maps.
I) Lines 4 and 5 added to replace original line 4, to correct the description to match
the surveyed right of way per Lane County's MLK ROW survey in~p filed March
2007 at County Survey File No. 40328.
2) Lines 6 through 18 added to replace original lines 6 through 16, to rdlect the
recent configuration change of City of Springfield owned tax lots 4601 and 5102,
portions of which are to be dedicated as street right of way.
3) Line 18 and the lines following, up to "And also including:" were added to
replace the original lines. The original description continued off the street right of
way ofMLK Jr. Parkway and onto the vacated railroad right of way. Said
railroad right of way is now part of private land, so it is omitted from the
description.
4) Section added. A strip of County road right of way that was create~ due to the
widening of City of Springfield owned and maintained street into land under
County jurisdiction. The purpose for this request to annex is to clean up the
County's partial jurisdiction of City maintained road, and restore the full right of
way jurisdiction to the City of Springfield. .'
5) Section added. A strip of County road right of way that was created due to the
widening of City of Springfield owned and maintained street into land under
County jurisdiction. The purpose for this request to annex is to cle<in up the
County's partial jurisdiction 'of City improved and maintained road;, and restore
the full right of way jurisdiction to the City of Springfield, ,
6) Section added: A strip of County road right of way that was created due to partial
dedications of street right of way to the City of Springfield over the. top of '
existing County road (said County road was using privately owned land for the
,right of way). The purpose of this request to annex is to clean up the County's
partial jurisdiction of City improved and maintained road, and restore the full
right of way jurisdiction to the City of Springfield. .
7) Section added: A strip of County road right of way atthe South end of Game
,Farm Road where it intersects Harlow Road. The purpose of this n,quest to annex
is to clean up the City's partial jurisdiction of the intersection of Game Farm and
Harlow, which will allow access to the City's traffic control feature's in the area
that pertain to the intersection, allow traffic planners access to jurisdictional
