I. REQUEST
This request is for tentative approval of a land division or partition to divide a
single parcel into two separate parcels,
II. BACKGROUND
The applicant attended a Developmental Issues Meeting with City staff on
November 10, 2005 (ZON2005-00054) to discuss the proposed partition and
rezone of the property, At that time staff stated that it appeared that the property
could be partitioned once it was rezoned from Low Density Residential to Medium
Density Residential provided that the proposed tax lots could meet the setback
requirements, The property has been rezoned from Low Density Residential to
Medium Density Residential (ZON2008-00013) on May 22, 2008,
Ill. SITE INFORMATION
The subject property is located on the south side of West "M" Street at the corner
of Rainbow Drive and is developed with a single family dwelling and a duplex, The
site address of the single family dwelling is 859 West "M" Street. The site address
ofthe duplex is 1395/1391 Rainbow Drive, The property is identified as tax lot
3001 of Lane County Assessor's Map 17-03-27-43, A copy of the Assessor's Map is
attached as Exhibit A which is located after the narrative, An aerial map is also
attached as Exhibit B. The property is currently zoned Low Density Residential.
The properties to the north, south and east are zoned Low Density Residential and
are developed with single family homes, Property to the west (Tax Lot 1700 of
Assessor's Map 17-03-27-34) is zoned Medium Density Residential. A map
showing the zoning of the surrounding properties is attached as Exhibit C.
The property is designated Medium Density Residential on the Eugene/Springfield
Metro Plan Diagram. Because of the apparent zone/plan conflict, the applicant
requested a city sponsored zone change to rezone the property from Low Density
Residential to Medium Density Residential (Zone2008-00013), A map showing
the zone/plan conflict is attached as Exhibit D,

IV, LAND DIVISION - TENTATIVE PARTITION CRITERIA
The following narrative outlines how the proposed land partition complies with all
the Tentative Plan Criteria set forth in SDC 5,12-125 (A through I) which are
applicable to the subject property,
"A. The request conforms to the provisions afthis Code pertaining to lot/parcel size
and dimensions"
Resnonsl"
The subject property is 11,761 square feet in size, The proposed partition to
divide the property into two lots would meet the density standards for parcels in
the Medium Density Residential zone which permits a minimum of two dwelling
units on the ,27 acre property, The single family dwelling would be located on
Parcell with a lot size of approximately 4,960 square feet The duplex would be
located on Parcel 2 and the lot size would be approximately 6,787 square feet A
photo showing the single family dwelling and the duplex is attached as Exhibit E,
Both parcels meet the setback and street frontage requirements set forth in the
Springfield Development Code,
Parcell has a 19,14-foot front yard setback, a 10-foot rear yard setback. The
interior side yard setback is 14,9.foot and the side yard that abuts the street has a
23,05-foot setback. There is approximately 75 feet of street frontage along West
"M" Street The existing single family dwelling located on Parcell takes access off
West "M" Street
Parcel 2 is developed with the duplex has a 26,9-foot front yard setback and an
11.4-foot rear yard setback, The side yard setback that abuts tax lot 3300 is 14,36
feet, The side yard setback that abuts the rear yard of Parcell is 6,1 feet There
was a roof overhang that connected the duplex and the single family dwelling
which has since been removed, A photograph showing the rear yard of Parcell
that shows that the roof overhang connecting the two dwellings has been removed
is attached as Exhibit F, Parcel 2 has approximately 80 feet of street frontage along
Rainbow Drive.

Refinement Plan diagram, Plan District map, and Conceptual Development Plan,

There are no Refinement Plans or Conceptual Development Plans that applicable
to the subject property,
"c. Capacity requirements of public and private facilities, including but not limited
to, water and electricity; sanitary sewer and stormwater management facilities; and
streets and traffic safety controls shall not be exceeded and the public improvements
shall be available to serve the site at the time of development, unless otherwise
provided for by this Code and other applicable regulations, The Public Works
Director or a utility provider shall determine capacity issues,"

There is sufficient capacity to serve the proposed partition, The site is currently
being serviced by electricity, water sanitary sewers and storm water management
facilities. A copy of the City's Storm and Sanitary Sewer Mapsheet C07 showing
the location of these services is attached as Exhibit G. According to Public Works
the proposed partition does not require a Stormwater Management System Study,
A copy ofthe email from Public Works is attached as Exhibit H. In order to handle
the stormwater runoff, there is a 4" corrugated PVC pipe that runs from the
dwelling on Parcellto Rainbow Drive and another 4" corrugated PVC pipe that
takes the stormwater to West "M" Street.
"0, The proposed land division shall comply with all applicable public and private
design and construction standards contained in this Code and other applicable
regulations, "
Res DonsI':
The proposed land division to divide a single parcel into two separate parcels will
comply with all applicable public and private design and construction standards,
A seven foot public utility easement along the street frontage of the property is
provided as part of the proposed partition,
"E. Physical features, including, but not limited to: steep slopes with unstable soil or
geologic conditions; areas with susceptibility offlooding; significant clusters of trees
and shrubs; watercourses shown on the WQLW Map and their associated riparian
areas; wetlands; rock outcroppings; open spaces; and areas of historic and/or
archaeological significance, as may be specified in Section 3.3-900 or ORS 97.740-
760,358,905-9555 and 390.235-240, shall be protected as specified in this Code or in
State or Federal law. "

minimize driveways on arterial and collector streets as specified in this Code or other
applicable regulations and comply with ODOT access management standards for

There is driveway access along West "M" Street that provides access to the single
family dwelling on Parcell. There is driveway access along Rainbow Drive that
provides access to the duplex on Parcel 2, Both driveways meet the standards set
forth in Table 4,2-4 for driveways on local roads, West "M" Street is fully
improved with curb, gutters and sidewalks, Rainbow Drive has not been
improved to City standards; therefore, the applicant is proposing to dedicate 5' of
street frontage along Rainbow Drive for future public improvements, This 5' right
of way dedication is indicated on the proposed partition, A Bargain and Sale Deed
along with a legal description of the property to be dedicated has been included as
part of the proposed partition, Once the notarized deed has been reviewed by the
City it will be recorded at Lane County Deeds and Records, A copy of the Bargain
Sale Deed is attached as Exhibit L
"G, Development of any remainder of the property under the same ownership can be
accomplished as specified in this Code,

The entire site is under the same ownership has been fully developed, The
property owner intends to sell the single family dwelling that is located on Parcel
1. There is an existing older duplex on Parcel 2 which could be redeveloped at
some point in the future and still comply with this Code,

The subject property is entirely within the city limits, therefore; this criterion does
not apply,
V. SUMMARY
The proposed partition separates the two existing dwellings onto their own tax lot
and would allow the owner to sell the dwellings separately, The city is currently
looking into land efficiency measures that would provide opportunities for infill
and redevelopment to allow for smaller lot sizes, These measures help to promote
more efficient use of the land that is currently in the city limits while still
providing for growth opportunities, This proposed partition is an example of how
these land efficiency measures can be used, The proposed partition does not
change the nature of the existing neighborhood and does not create the need for
additional services, The applicant recognizes that at some point Rainbow Drive
will be improved to city standards and has provided additional right-of-way to
allow for the future improvement.
Based on the information provided in this narrative the City may approve the
proposed partition as submitted,
