MDS shall ensure compliance with :specific appearance; transportation safety and efficiency; and stormwater management standards specified in the Springfield Development Code (SDC) and otherwise protect public health, safety and welfare. Applicability: SDC 5.15-110.A.3.d requires the property owner'to bring the entire property into compliance with the standards of SDC 5.15-105 when there is a change of use of a building or property. However, when there is a property containing multiple uses required improvements shall be installed under the rule of proportionality based on the number of businesses on the property. If the property contains more than three uses, the Director and the property owner may enter into an a'greement so that as a use changes or expands, a percentage of the property shall comply with MDS requirements with the intent that the total property will meet MDS requirements over time. . . A percentage' of these improvements, per SDC ~.15-120 as specified, shall be installed and Final Occupancy shall be contingent upon the completion of the requir,ed site improvements: Applicable Special Use Standards: The site is within a 5 to 10-year Time of Travel Zone for the Sports Way Wellhead in the Drinking Water Protection Overlay District as per Springfield Development Code, Section 3.3-200. This application does not meet the criteria of Section 3.2-225 requiring a DWP Overlay District Deve!opment Application. ~ Complies as Shown on Plot Plan 1) A five-foot wide landscaped planter strip, including street trees, with approved irrigation or approv.ed drought resistant plants as specified in SDC Sections 4.4-100 and 4.2-140 shall be installed between the sidewalk and parking areas or buildings. Proposal Complies when the following Condition(s) is/are met: Condition 1: Submit a complete landscape plan showing replanting of the northwest corner, in compliance with SDC 4.2-140 and 4.4-105.F. 2) Trash receptacles and outdoor storage areas shall be screened by a structure or enclosure permanently affixed to the ground as specified in SDC Section 4.4-110. Finding: The Springfield Engineering Design Standards and Procedures (EDSP)3.03.4.A references higher-risk activities that may contribute to water quality degradation. This section is based on Chapter 4.4.C of the City of Portland Bureau of Environmental Services' (BES) Stormwater Management Manual, which includes solid waste storage areas, containers, and trash compactors. Required paving and other impervious surfaces on th'e site shall comply with on-site stormwater management standards as specified in SDC Section 4.3-110/115. Finding: The Springfield Engineering Design Standards and Procedures (EDSP) 3.03.5 requires that one hundred percent (100%) of parking lots and paved areas be pre-treated for stormwater quality. Finding: This property was originally developed with 68 parking spaces, therefore qualifying it as a non-conforming use per SDC 5.8-115. Pursuant to the current SDC, however, the site requires a minimum of74 parking spaces. The applicant is proposing the removal of six additional parking spaces to accommodate this project. Section 5.8-125.B.3 requires that any expansion of a non-conforming use shall not cause any significant impact compared to the current use or building or structure on the surrofJnding area including on- site parking placement. Proposal complies when the following Conditions are met: Condition 3: The existing catch basin shall be retrofitted with a City- approved stormwater filter insert and a maintenance agreement put in place to provide for the ongoing maintenance needs of the filters. Con(jition 4: Provide a parking analysis for the site showing that further reduction of the substandard number of parking spaces will not adversely impact access or existing, proposed and surrounding uses. 5) Access onto the public right-of-way shall comply with SDC Section 4.2-120. Finding: The Transportation Division requires service lanes to be 70 feet in length for drive through facilities to accommodate the vehicles generated by each service window. The proposed service lane for the drive-up window on the north side of the structure is only 40' in length and only'able to accommodate two vehicles. Additional vehicles waiting in this line would block the access aisle creating an unacceptable situation possibly affecting the Main Street entrance. The service lane on the south side of the structure is only 20' in length; however it appears that vehicles may be able to be accommodated without affecting access to on-site parking or drive aisles. Finding: Directional signage or striping must be provided on-site to direct , drivers into the appropriate access aisles meeting the 70 foot standard. Finding: The existing vehicle access to the site is provided by a 39 foot driveway entry onto Gateway Street. The maximum driveway width allowed by the SDC is 35 feet. Condition 6: The proposed pedestrian access leading from'the Gateway Street sidewalk to the coffee kiosk will be constructed per ADA requirements and, along with the patio area, shall be located outside of the public right-of-way. Condition 7: Final Site plan shall be designed to provide for the required 70 foot service lane for the drive-up window on the west side of the kiosk. Showing where four vehicles will be able to be accommodated waiting for the east service window so that vehicles will not block access to parking or drive aisles. Please use shading to show the location of the service lanes. Please provide dimensions for the service lanes (width and length). Condition 8: Final Site plan shall show where four vehicles will be able to be accommodated waiting for the south serVice window,so that vehicles will not block access .to parking or drive aisles. Condition 9: Final Site Plan shall show all proposed on-site pavement markings (arrows etc,..). Condition 10: Final Site plan shall show the relocation of the proposed pedestrian path adjacent to the service aisle. St?ff recommends that the path extend through the patio area and cross the service aisle at a perpendicular angle. 6) Concrete sidewalks shall be installed where the site abuts a curb and gutter street as specified in SDC Section 4.2-135. This agreement will be prepared by Staff and upon approval of the Final Plot Plan; must be signed by the property owner prior to iss,uance of a building permit. THE APPLICANT MAY SUBMIT CONSTRUCTION OR BUILDING PLANS TO OTHER CI1Y DEPARTMENTS FOR REVIEW PRIOR TO FINAL SITE PLAN APPROVAL IN ACCORDANCE WITH SDC 5.17-135 AT THEIR OWN RISK. ALL CONCURRENT SUBMITTALS ARE SUBJECT TO REVISION FOR COMPLIANCE WITH THE FINAL PLOT PLAN. A DEVELOPMENT AGREEMENT IN ACCORDANCE WITH SDC 5.17-140 WILL NOT BE ISSUED UNTIL ALL PLANS SUBMITTED BY THE APPLICANT HAVE BEEN REVISED. CONFLICTING PLANS CAUSE DELAYS. The construction of the required improvements shall begin within 90 days of the date of this decision. If the established time line cannot be m:et, the, applicant may submit a written request for a time line extension as specified in SDC Section 5.15-125AA.b. , The,Director may allow a (me-time extension of the 90-day start, of construction time line due to situations including but not limited to, required permits from the City or other agencies, weather conditions and the unavailability of asphalt or the unavailability of street trees. If the time extension is allowed, security shall be provided as specified in SDC Section 5.15-125.B of this Article. The time line extension shall not exceed 90 days. If the established time line is not met and the applicant has not requested an extension, the Director shall declare the application null and void 'if the property is occupied and the property owner shall be considered in violation of this Code. If the established time line is not met and the applicant has requested an extension and that time line has not been met, the Director may require the improvements be installed as specified in SDC Section 5.15- 125.C. Permits That May Be Required: . All new sewer taps will require permits from .the Public Works Department prior to'connection. . Sidewalks and driveway curb cuts and closures require permits from the Public Works Department. . Building permits will be required for the construction of the building and the paving of the parking lot. . An LDAP permit will be required for all grading, filling and excavating being done. . Sign Permit-NOTE: Signs are regulated by the Springfield Municipal Code Article 9, Chapter7. The number and placement of signs must be coordinated with the Community Services Division. The location of signs on a Site Plan does not constitute approval from the Community Services Division.
