AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF SPRINGFIELD FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY OF SPRINGFIELD AT A SPECIAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 1994, CONCURRENTLY WITH THE GENERAL ELECTION TO BE HELD IN LANE COUNTY ON SAID DATE, THE FOLLOWING PROPOSED AMENDMENT TO THE CITY CHARTER TO PROVIDE FOR THE ELECTION OF THE MAYOR AND COUNCIL IN WHICH THE OUTCOME IS FINAL UPON RECEIPT OF A MAJORITY OF THE VOTES CAST, PROVIDING FOR USE OF THE SAME ELECTION BOARDS AND POLLING PLACES AND MANNER OF ELECTION FOR SAID ELECTION AS SHALL BE USED IN THE COUNTY-WIDE ELECTION, AND ALL ACTS NECESSARY FOR CARRYING ON SAID ELECTION. THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: section 1: That the City Council finds it advisable to submit to the electors and legal voters of Springfield, Lane County, Oregon, the question as to whether the Springfield Charter should be amended to provide for the method of election of the Mayor and Council in which the outcome is final only upon a candidate's receipt of a majority of the votes cast, as more particularly set forth as follows: . (See Exhibit "A" attached hereto and incorporated herein as fully and completely as though set out in full herein.) section 2: That a special election shall be held in Springfield, Lane County, Oregon, on Tuesday, November 8, 1994. There shall be submitted to the electors and legal voters of said City for their approval or rejection the following question: (See Exhibit "B" attached hereto and incorporated herein as fully and completely as though set out in full herein.) section 3: Said question shall be placed upon official ballots by the City Recorder to be voted upon by the electors of the City of Springfield at said election. The City Recorder may provide for such official ballots by arranging for their insertion upon the election ballots provided by the County Department of Records and Elections. Section 4: The City Recorder shall provide or cause to be provided such poll books, ballots, ballot boxes, tally sheets and other supplies for the hereinafter specified polling places as are necessary for the carrying on of the election which shall be delivered to the election boards by the city Recorder or shall be caused by her to be delivered thereto. . section 5: The city and county precincts of the City of Springfield shall be uniform in boundary and have the same election boards and polling places in the City and said election .. . . . It f' shall be in the same places as provided for by the County of Lane for the general election to be held on the 8th day of November, 1994, and said chairman and clerks in the said general election shall be identical to the ones serving in said City of Springfield special election. section 6: The polls shall be open at each of said polling places at 8:00 a.m. and shall be closed at 8:00 p.m. on said election day. section 7: Notice of said election shall be given by the City Recorder publishing notice thereof in The Springfield News, a newspaper prepared and published in Springfield, Oregon, by two publications of said notice, the first of which publication shall be not less than ten days prior to the time of the election. Section 8: In the event the Lane County Elections Administrator shall timely and lawfully exercise his discretion to require said special election balloting to be conducted by mail, then the manner of election shall be in all respects consistent with the applicable requirements of Oregon Revised Statutes and Chapter 1, Article 16, of the Springfield Code 1965. Btf}~p'~- Ma or ATTEST: ~~ City Recorder EXHIBIT "A" "section 3A. Mavor and Council Method of Election, Outcome Final Upon Receipt of Maioritv Vote. The first voting for Mayor or Councilor during a year will take place at the same time and places in the City as the state-wide biennial primary election that year. Any candidate for Mayor or City Councilor who shall receive a majority of all votes cast at the primary election shall, be declared to be elected to the office for which he or she is a candidat~, effective as of the date of the state-wide biennial general election, and no further elections shall be held for such office. If at the primary election no candidate receives such a majority, the two candidates receiving the two highest numbers of votes cast for the office shall be the only ones whose names appear on the ballot for voting at the same time and place as the state-wide biennial general election of that year as candidates for that particular office. The candidate who rec~ives a majority of the votes cast at the state-wide general election for the office is elected to that office and is entitled to a certificate of election thereto." " " " Attachment A - Page 3 CAPTION OUESTION SUMMARY/EXPLANATION EXHIBIT "B" BALLOT TITLE Mayor and Council Elections; Majority Vote Required for Election Shall Springfield Charter be amended to provide that election of Mayor and City Councilors requires majority vote? Amends Springfield Charter to provide that to be elected, any candidate for Mayor or Council shall receive a majority of all votes cast. Any candidate receiving a majority at the state-wide primary election is elected. If no candidate receives a majority, a run-off election between the two candidates receiving the highest number of votes will occur at the general election and the candidate who receives a majority of the votes is elected.
