The property subject to this application, hereinafter referred to as 'the property,' is located at the northeastern corner of Partridge Way and Mallard Ave., and has an address of 1723 Mallard,. Springfield. The property can be further described as tax lot 2200, assessor's map 17-03-22- 13. 2. The property is about 8750 square feet in size and is currently occupied by a market and a mobile home. The surrounding properties as zoned AGT and are developed with single-family residences.' 3. The property is within the Willakenzie Fire Protection District and receives water'from the Rainbow Water District, Sewerage is provided by an on-site subsurface disposal system, The property receives police protection from the Lane County Sheriff's Department and the Oregon State Police. The Glenwood Transfer Station furnishes the solid waste disposal needs of the property. which is also within the service boundaries of' School District 4J, 4. The mobile home currently on the property served as a caretaker's residence under County temporary us'e permit approval between 1973 and 1978. The mobile home has also served in this capacity from 1978 until present although no temporary permit was requested of or issued by the County for such a use. .' . . Traffic on Mallard Avenue and Pheasant Blvd. aVerage about 900 and 1000 daily, respectively, 6, The applicant has submitted a signed agreement, dated February 25, 1985, between the resident of the mobile home, John Glass, and the operator of the grocery store, Jerry Goodnough. The agreement provides that the resident shall provide certain caretaking duties for the grocery Store operator in consideration for which the operator will reduce the monthly rent for the resident. Decision THE REQUEST FOR A TEMPORARY PERMIT FOR A CARETAKER MOBILE HOME WITHIN A C-2 DISTRICT (PA 3279-84) IS APP110VED subject to the folloWing conditions: 1, The duration of the temporary permit shall be for five years or the actual operation of the caretaker activity or the existence of the grocery store, whichever time is the lesser. 2. At all times during the duration of the temporary use permit there shall be on file With the Director of the Lane County Land Management Division, a valid contract between the resident of the caretaker mobile home and the operator and/or owner of the grocery store. Said Contract shall detail the caretaker services to be provided and the consideration paid therefore. 3, The vacant service station on the property shall not be used for the commercial storage or maintenance of vehicles. However, the resident of the caretaker mobile home shall be permitted to maintain and store personal vehicles Within the structure'of the service station. 4. A mobile home permit and an authorization notice for the existing sewage disposal system must be obtained from Lane County. Justification for Decision (ConclUsion), The Eugene-Springfield Metropolitan Area General Plan deSignates the property as Low Density Residential. The property is zoned C-2 Neighborhood Commercial which is permitted in residential areas Without a commercial plan designation (Pg, II-E-5). I. PLAN CONFORMITY The applicant is requesting a temporary permit to allow an existing mobile home to serve as a caretaker residence for the market located on the property, Lane Code lO,325-15(1)(b) allows the use of existing structures designed for a use not allowable in the applicable zoning district if the location. size. design and operating characteristics of the proposed Use: II. The mobile home has served in the capacity of a caretaker's residence for many years and with County approval between 1973 and 1978. Testimony was presented that burglaries are almost eliminated when a person is living on the premises as a' caretaker. The only negative testimony concerned the possible use of the vacant service station on the property by the caretaker. This testimony primarily concerned the presence of heavy vehicles allegedly being maintained by the resident of the mobile home. Information presented at the January 10 hearing demonstrated that the vehicles stored and maintained on the property were owned by the resident of the mobile home and were not being repaired or stored as a part of a commercial venture. (ij) Will not be adversely affected by the development of abutting properties and the surrounding vicinity. The property is surrounded by AGT zoned parcels all occupied with res idences, Traffic on surrounding roads, Mallard Avenue and Pheasant 'B1vd. are not excessively heavy, being about 900 and 1000 trips per day, respectively, No adverse effects upon the mobile home from the surrounding vicinity or abutting properties have been identified.
