RE: Courtesy Inspection at 7406 Main Street
Dear Ms. Callahan:
At your request, the Building Safety Division conducted a Courtesy
Inspection at 7406 Main Street on November 28, 1989. I have attached
a copy of the letter that was delivered to Mr. Arie Mack Moore which
lists the deficiencies for your information.
This letter is to inform you that due to the unsafe conditions of the
structure, the building will be posted DO NOT OCCUPY on December 6,
1989, and for your safety, you must vacate the building on or before
this time. Failure to comply will constitute a violation punishable by
a fine not less than $50.00 or more than $1,000.00 or imprisonment for
a term not exceeding 100 days or both such fine and imprisonment.
Temporary heating, cooking, and/or lighting devices, such as kerosene
lamps, camping stoves, candles, etc., are not to be used because of
the high probability of fire potential.
Attached is a list of emergency shelters available, and other
resources which may assist you.
If you have any questions, please feel free to either contact Tom

RE: Courtesy Inspection At 7406 Main Street, Springfield, Oregon
Dear Mr. Moore:
As a result of a tenant request, the City of Springfield Building
Safety Division inspected the structure located at the above
referenced address. The structure was found to be in violation of the
Springfield Housing Code.
Due to the condition of the structure, the building will be posted DO
NOT OCCUpy on December 6, 1989. The following violations must be
repaired and/or replaced prior to reoccupying the structure. Prior to
the repair and/or replacement, all appropriate permits shall be
obtained as indicated below:
Structural
1. There is major structural damage in the lower portion of the
house. This area must be completely repaired in order to meet
minimum housing standards.
2. The walkway area has deteriorated to a point of being unsafe to
use. This must be completely removed and replaced.
Electrical
1. The outlets in the living room must be resecured.
2. A11'l!xposed wiring must be protected from physical damage and
secure in an approved manner.
3. Repa ir all 1 ight fixtures.
4. Provide cover tor service panel.
5. Replace all broken outlets, light switches and covers.
Plumbina
1. The tub/shower in the basement leaks and must be repaired.

2. The plumbing work that has been done in the structure was
performed without the appropriate permits or inspections. The
entire plumbing system in the structure needs to be repaired
and/or replaced in order to meet minimum standards.
Mechanical
1. The only source of heat in the structure is a wood stove. All
dwelling units must be provided with heating facilities capable of
maintaining a room temperature of 70 degrees F. at a point three
feet above the 'floor. Therefore, a heating system in addition to
the wood stove must be installed.

Dear Ms. Hopper:
Your letter reporting the results of your Courtesy Inspection of the
building that the cemetery owns at 7406 Main St, is very much
appreciated. Your courtesy inspection and letter of intent to post the
building is an answer to my prayers.
The tenants that you refer to include two California Men that moved
into our buidling WITHOUT OUR PERMISSION, about 60 days ago
and we have exercet every effort possible to make them vacate the
building. The woman is an ex-employee who went to work for us on
a part time basis this spring. In the latter part of May she came to
work very distressed saying she had to move that night and did not
have any place to go.' She pleaded with us to let her just sleep in the
cemetery shop for a few nights which she said would be much better
than sleeping in her car on the streets. Then when she found out
that the cemetery owned the building at 7406 Main street which we
were using mainly for storing our building materials, ete, she pleaded
with us to allow her to move into the upper portion which we were
not using, She has never paid one dime in rent, When she
terminated her part time employment about three weeks ago we
requested that she vacate the building immediately. She refused to
move so on November 27, 1989 we had our attorney to serve the 72
hour notice to vacate the building. Since she has never paid any rent,
which the 72 hour notice is used for, our attorney also used the 30
day notice law,

Since they have verbably threatened my life twice, I have been afraid
to even enter the bottom portion of the building.
Your building department is probably aware that I inherited that old
building when I took over this financial distressed cemetery. The
cemetery office was in the upstairs portion of the building when I
took over. This is the portion that the lady moved in. I moved the
cemetery office into our new building in the cemetery a few years
ago. We have mainly used that old building for storage of our
building materials and equipment since we had to postpone
construction of our buildings in the cemetery. Our plans for that
building has been uncertain every since we took over mainly because
of the prority of building these crypts which people had purchased 15
years ago. Some of the purchasers of these crypts had died before I
took over and were stored elsewhere. This made building the crypts
certainly a priority above doing any thing with the old building where
the cemetery office used to be at 7406 main street. I knew that the
building needeed attention but I did not know that it was unstrucual
sound which your Courtesy Inspection has found it to be
unstructional sound.
Your Courtsey Inspection has also revealed what I have been afarid
of since these two California men moved in with out my permission.
They are apparently destroying the building because your Courtesy
Inspection reveals that there are broken light fixtures, broken outlets
and broken light switches and covers. The last time I was in the
building the service cover panel was on and none of this electical
items were broken or torn loose.
Apparently they have taken out the oil furnance, valued at around
$5,000.00, that has been in that house for many years and provided
all the heat needed, I am assuming that they took the oil furnance
out because your Courtsey inspection states:

Since you have found the building to be UNSAFE TO OCCUPY due
to the major structual damages in the lower portion of the building,

due the unsafe very dangerous Electricial condition, due to the broken
plumbing which makes it unsanitary and due to the fact that there
is no heat source in the building except a wood stove which is
probably not installed according to building codes, WHY WAIT TILL
DECEMBER 6TH TO POST THE BUILDING?
I am asking you to Please post the building today before one of these
people get hurt or some one else gets hurt coming to see these
people. Since these two California Men moved in around 60 days ago
there is much traffic in and out of this building all hours of the day
and night and especially during the night.
I do not have the time or money to do the necessary repair on the
building at this time. Even if I did have the time and money to do
this I would not enter the building since they have threatened my life
two times. Therefore why wait till December 6th. to post the
building? Why can't you post it today?
You may save some ones life by posting the building today.
I wish to thank you for your Courtesy Inspection and for your letter
of this date. With your authority may be we can make these people
vacate the building before some one gets hurt. Just the very
dangerous Electical condition which you have found is more than
reason to post this building and make them vacate the building
before some one gets hurt or killed.

Please be advised that this office represents Arie
Mack Moore. Please be advised 'that this letter is notice
to you under the Oregon Revised Statutes of termination of
your tenancy at the residence of 7406 Main Street, Springfield,
Oregon 97478.
You have failed and refused to pay the rent as agreed
with Mr. Moore and you are he,t;eby being put on notice that you
have 72 hours to pay rent in the amount of $250 or Mr. Moore
will commence a forcible entry detainer action against you.
That in addition, you are being notified that under the
)0 day notice rule, you are being notified that the tenancy will
cp.ase within 30 days of the date of this letter. You are also
llP.ing requested to vacate the premises at that time or a forcible
entry detainer action will be filed against you.

Dear Mrs. Callahan:
As you know in May of this year, you asked if you could sleep in the cemetery
shop for a few nights because you had to move out of where you had been
staying. Then when you found out that the cemetery owned the old house at
7406 main st., which we were uSing mainly for storage, but part of the top portion
was vacant, you begged me to allow you to move in to the portion that was
vacant. I allowed you to move in that vacant portion of the house because you
claimed that you did not have any money to pay any rent. You claimed this would
help you if you could live there. I only gave permission for you to live there and
I did agree that your 12 year old daughter could come and live with you for the
summer. I made it very clear that no one else could live there. You have
allowed two men from California to move in. '
You have not paid one dime for rent all the time you have been living in that
house.
We were notified today by Springfield Building Department that they have found
the building to be UNSAFE. Therefore you MUST VACATE THE BUILDING
IMMEDIATELY.
The two men from California that have moved in, WITHOUT OUR PERMISSION,
MUST ALSO VACATE THIS UNSAFE BUILDING IMMEDIATELY.
I am asking the City of Springfield Building Safety Division to post that building
that it is unsafe. They will post this with in the next few days as follows:
"DO NOT OCCUPY"
"BUILDING UNSAFE"
Now the City of Springfield Building Safety Division and the Springfield City
Police will make you vacate the building immediately when it is posted.
The only furniture you took into that building was one old single bed and one old
chest of drawers.
THIS IS A WARNING TO YOU. Do not take any of the other furniture OR WE
WILL HAVE YOU ARRESTED. We have an inventory of all the furniture along
with the purchase agreements to show that we are the owners. We also have an
inventory of all the other equipment and of all the building materials that are
stored in the basement, the two front rooms and in the building to the east of the
house. I am giving a list of the furniture that we own to the police. Therefore you
we are warning you that we will have you arrested if you take any of the

furniture or any of the equipment or building material.
The electric heater that you took out of the cemetery shop without permission and
the two DeLonghi oil based, electric radiator heaters must also be left there.
As you know we have hired Collins Security to help us patrol our property.
WE HAVE 24 HOUR SURVEILLANCE ON OUR PROPERTY. IF YOU START
LOADING ANY OF OUR FURNITURE OR ANY OF OUR EQUIPMENT OR ANY
OF OUR BUILDING MATERIAL, WE WILL HAVE YOU ARRESTED ON THE
SPOT.
Please make it easy on your self. Move out of that UNSAFE BUIDLING
IMMEDIATELY. DO NOT TAKE ANY OF OUR FURNITURE OR ANY OF OUR
EQUIPMENT OR ANY OF OUR BUILDING MATERIALS.
ONE LAST WARNING:
Your son has threatened my life twice now. Once was here in the cemetery with
another witness hearing his threats against my life. Neither you, nor your son
or the other stranger from California has any business on these cemetery grounds.
None of you have any relatives buried in this cemetery. Infact none of you have
any friends buried here because all of you have just recently came up from
California. Therefore you have NO REASON OR BUSINES WHAT SO EVER TO
COME IN THIS CEMETERY. Your son came into this cemetery last Saturday
and not only threatened my life but disrupted our business, upset and scared
bereaved families. The police have your sons threat on my life on the computor.
They will be here within minutes and arrest your son if he treaspasses again by
coming on these cemetery grounds.
