ORDINANCE NO. 5729 (SPECIAL) AN ORDINANCE VACATING THAT PORTION OF S PLACE, A CUL-DE-SAC IN KING ARTHUR SUBDIVISION, A PUBLIC RIGHT-OF-WAY BETWEEN LAURA STREET AND PIONEER PARKWAY, IN THE CITY OF SPRINGFIELD, LANE COUNTY OREGON. WHEREAS, the Springfield City Council has designated King Arthur Subdivision for Light Medium Industrial or Community Commercial uses through adoption of the Gateway Refinement Plan; and WHEREAS, the Light Medium Industrial or Community Commercial development of this property is facilitated by this vacation; and WHEREAS, such vacation is in the best interest of the City in carrying out its plans and programs for the general development of the City; and WHEREAS, lawful notice of the proposed vacation was published and posted; and WHEREAS, the Springfield Ci ty Council met in Council Chambers, at 225 Fi fth Street, on Monday, the 7th day of March, 1994, at the hour of 7:00 p.m., to hear any objections to the proposed vacation and ~ persons appeared to object; NOW, THEREFORE, THE CITY COUNCIL DOES ORDAIN: Sec t ion 1: The Council finds that legal notice of the hearing was lawfully eUblished and posted; that 0 objections were made at the vacation hearing held; hat public interest will not:J)e impaired by the vacation of the public right-of-way and that said right-of-way vacation will be in the bes~ interest of the public and increase the benefit of the property involved. Section 2: The public right-of-way in the City of Springfield, as described in the following legal description, is declared to be vacated: A CUL-DE-SAC IN KING ARTHUR SUBDIVISION BETWEEN LAURA STREET AND PIONEER PARKWAY and more specifically described as: S Place as dedicated within the plat of KING ARTHUR, as platted and recorded in File 73, slide 267, Lane County Oregon Plat Records, in Eugene, Lane Coun ty, Oregon. The Parcel being vaca ted con tains 29,853 square feet, more or less. Ordinance Page 1- . ~ . . . Section 3: The findings in the staff report for Jo. No. 94-01-10 are hereby made part of this ordinance by reference. Section 4: The Ci ty Recorder is directed to file certified copies of this ordinance with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor. Section 5: It is a further condi tion of this vacation that nothing herein contained shall cause or require the removal of or abandonment of any sewer, water main, gas main, condui t of any kind, pole or thing used or intended for any public service.
