AN ORDINANCE REGARDING SYSTEM DEVELOPMENT CHARGES. AMENDING ARTICLE II SYSTEMS
DEVELOPMENT FEES OF CHAPTER II. LOCAL IMPROVEMENTS OF THE SPRINGFIELD CODE;
AMENDING SECTIONS' 2-11-1 "DEFINITIONS. QUALIFIED PUBLIC IMPROVEMENTS. PART C"

.., DECLARING AN EMERGENCY. ,-
THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:-
SECTION 1: "Qualified Public Improvements", Part(c) of Section 2-11-1
'. '- .' ,"DEFINITIONS" of Article II Systems Development fees of Chapter II "Local
Improvements of the Spri ngfi e 1 d Code" is hereby amended as follows:

Not located on or contiguous to a parcel of land that is the
subject of the development approval,
Located in whole or in part on or contiguous to property
that is the subject of development approval and required to
be built larger or with greater capacity than is necessary
for the particular development project to which the
improvement fee is related."
SECTION 2: Subsection (2) of Section 2-11-9 "Credits" of Article II Systems
Development Fees of Chapter II "Local Improvements of the
Springfield Code" is hereby amended as follows:

"(c) 1.
Adds;
"The credit provided for by this subsection shall be only for the
improvement fee charged for the type of improvement being constructed.
and qualified public improvements under this subsection may be granted
only for the cost of that portion of such improvement that exceeds the
minimum standard facility size or capacity needed to serve the
particular development project or property."
SECTION 3: It is hereby found and determined that matters regarding the
System Development Charges are matters affecting the public health. safety and
welfare and that an emergency exists and that this ordinance shall therefore
take effect immediately upon its passage by the City Council and approval by
the Mayor, .
