The recommended findings and conditions outlined below are provided for your use in preparing the land-use decision, SANITARY SEWER , /, Finding: Section 32.100 of the SDC requires thaI sanitary sewers shall be installed to l' serve each new development and to connect developments to existing mains, Additionally, installation of sanitary sewers shall provide sufficient access for maintenance activities, J Finding: The applicant has proposed using the existing 8 inch wastewater line located at the northeast corner of the property, The applicant has also proposed removing the ' existing 8 inch wastewater line that crosses the parcel form the northeast tO,the south west, and replacing it with new 8 inch wastewater lines that run west and south along the respective building frontages, Finding: Section 2.02.1 ofthe City's Engineering Design Standards and Procedures ) Manual (EDSPM) states that when land outside a new development will logically direct flow to sanitary sewers in the new development, the sewers shall be public'sewers and shall nonnally extend toone or more ofthe property boundaries. / Finding: The City's EDSPM states in Section 2,02.8,that sewers shall be lo'cated in the right-of-way at street centerline or within 5 'feet of centerline of the street. Sewers in j easements shall,only be allowed after all reasonable attempts to place the mains in the rights-of-way have been exhausted, Finding: Pursuant to Chapter 3,03A.A of the City's Engineering Design Siandm:ds and Procedures Manual and Section 4.4 of Portland's Stonnwater Management Manual, solid waste storage areas shall be covered and hydraulically isolated from potential stonnwater runoff, and directed to the sanitary sewer system,. .W3 Condition: Prior to approval of the Final Site Plan, the applicant shall plumb the recycle/refuse area to the sanitary sewer system. Finding: To comply with Sections 32.110 (4) & (5), storm water runofffrom the site will be directed into a series of area drains, pipes, and three vegetative water quality swales, ( before being discharged into the public stonn system in Game Farm Road and along the south property line into and existing drainage ditch on ODOT property, ,The vegetative water quality swales will be located along the north parcel boundary and'southeast parcel boundary. j' Finding: The Applicant's proposal shows the eastern half of the proposed drainage basin #2 (0.347 acres) shall be directed to vegetative swale #2, However, an existing area drain is depicted in this proposed basin on Sheet UT-2. I Finding: The applicant's proposal shows t~e rooftop drai~age directed to the public stonn system in Game Fann Road. ' J Finding: The eXist.ingpublic stonnwater system, to which the applicant proposes connection, has limited capacity. Condition: Prior to approval of the Final Plat, the applicant shall include a maintenance document with provisions to ensure functionality of the three proposed vegetative swales. -; WATEROUALlTY Finding: Under Federal regulation bfthe Clean Water Act (CW A), Endangered Species Act (ESA), and National Pollutant Discharge Elimination System (NPDES), the City of Springfield is required to obtain, and has applied for, a Municipal Separate Stonn Sewer System (MS4) permit. A provision ofthispennit req'uires the City demonstrate effOlis to reduce the pollution in urban storm water to the Maximum Extent Practicable (MEP), j Finding: Federal and Oregon Department of Envjrorunental Quality (ODEQ) rules, require the City's MS4 plan address six "Minimum Control Measures." Minimum. Control Measure 5, "Post-Construction Stonnwater Management for New Development and Redevelopment," appliesto the proposed development. , Finding: Minimum Control Measure 5 requires the City of Springfield to develop, I implement and enforce a program to ensure the reduction of pollutants in storm water runoff to the MEP. The City must also develop and implement strategies that include a. combination of structural or non-structural Best Management Practices (BMPs) , . appropriated for the conlmunity. 'Finding: Minimum Control Measure 5 requires the City of Springfield use an,ordinance or other regulatory mechanism to address post construction runoff from new and re, / development projects to the extent allowable under State law, Regulatory m'echanisms used by the City include the Springfield Development Code (SDC), the City's Engineering Design Standards and Procedures Manual (EDSPM) and the filture Stormwater Facilities Master Plan (SFMP). Section 3,03AE of the manual requires a minimum of 50 percent of the non-building rooftop impervious area on a site shall be treated for storn1water quality improvement using vegetative methods. Finding: To meet the requirements of the City's MS4 pennit, the Springfield Development Code, and the City's EDSPM, the applicant has proposed three private / vegetative water quality swales. The private vegetative swales will be located along the north and southeast boundaries of the parcel. Two separate grasses are specified for planting in the vegetative swales at a rate of 20 lbs, per acre, Finding: The vegetation proposed for use in the swales will serve as the primary pollutant jemoval mechanism for the stonnwater runoff, and will remove suspended solids and . pollutants through the processes of sedimentation and filtration. Satisfactory pollutant removal will occur only when the vegetation has been fully established. Condition: Prior to Final Plat approval, the applicantshall submit a seed mix for the three private vegetative water quality swales and the public grassy swale/detentiori pond, The seed mix shall meet the requirements of the City's interim design standards as required in Section 3,02 of the EDSPM, The City of Portland stormwater management manual Section 5AA may be referenced for design of this seed mix. ~ ~ c".f~ ) r~ ' Condition: To ensure a fully functioning water quality system and meet objectives of Spl~ngfield's MS4 pennit, the Springfield Development Code and the EDSPM, the proposed private vegetative water quality swale shall be shall be fully vegetated with all vegetation species established prior to approval of Final Plat. Alternatively, if this condition cannot be met, the applicant shall provide and maintain additioniil interim erosion control/water quality measures acceptable to the Public Works Department that will suffice until such time as.the swale vegetation becomes fully establish~d, , . . . j PUBLIC STREETS. SIDEWALKS & IMPROVEMENT ARGEEMENTS . Finding: Gateway Street and Game Fann road are fully improved streets with curb gutter and sidewalk, so no improvements are anticipated by the applicant. UTILITIES. EASEMENTS AND RIGHTS OF WAY, Finding: Section 32,120 (3) of the Springfield Development Code requires' each development area to be provided with a water system having sufficiently sized mains and J lesser lines to furnish adequate supply to the development and sufficient a~cess for maintenance, Springfield Utility Board coordinates the design ofthe water system within Springfield city limits. The water and utility lines are not located in an easement, nor are they proposed to be located in an easement. 7 Finding: The applicant has proposed a 7 foot public utility easements along the frontage of C Street, satisfying Section 32,120 of the SDC.
