ORDINANCE (Special)
No. 5700
AN ORDINANCE ADOPTING THE REPORT OF THE CITY ENGINEER FOR IMPROVEMENTS ON
SOUTH 52ND PLACE FROM MAIN STREET TO 100 FEET SOUTH OF CYNTHIA COURT, AND
VICINITY (1-792) AND DECLARING AN EMERGENCY.
THE SPRINGFIELD CITY COUNCIL DOES ORDAIN AS FOLLOWS:
Section 1: The Springfield City Council on April 6, 1992, did initiate
construction of improvements on South 52nd Place from Main Street to 100 Feet
South of Cynthia Court, and Vicinity (1-792) including paving, curbs and
gutters, sidewalks, street trees, street lighting, storm drainage, and
sanitary sewer rehabilitation.
At the direction of the Council, the City Engineer filed his report with
the City Recorder on June 9, 1993, and the report filed is hereby adopted.
At the direction of the City Council at the June 21, 1993, Council
meeting, the scope of work for sidewalk construction was amended as follows:
sidewalks are to be installed on the west side only, but the right-of-way for
future sidewalks, if and when needed, is to be acquired on the east side of
South 52nd Place from the south end of South 52nd Place up to the property
that was zoned community commercial.
Section 2: Upon receipt of the above Engineer's Report, the Finance
Director gave notice informing all interested property owners benefitted by
the proposed improvement to appear before the Council in the City Council
Chambers, City Hall, 225 North 5th Street, Springfield, Oregon, at 7:30 p.m.
on June 21, 1993, to present their views for or against such project. The
public hearing was held and 2 persons appeared and protested.
Section 3: The Finance Director is directed to advertise that bids will
be received for the construction of the above improvement project in
accordance with the City's general conditions and standard specifications and
that the project shall be awarded in the City Council Chambers of City Hall.
The Council reserves the right to reject any or all bids deemed
unsatisfactory.
Section 4: Whereas it is necessary that such improvement should be made
at once, the Council declares that an emergency exists and that this ordinance
shall be effective after its passage by the Council and approval by the Mayor.
Adopted by the Common Council of the City of Springfield this 21st day
of June, 1993, by a vote of 4 for and 0 against.
Approved by the Mayor of the City of Springfield, Oregon, this 21st day
of June, 1993.
