ORDINANCE NO. 5693
(GENERAL)
AN ORDINANCE REGARDING SYSTEM DEVELOPMENT CHARGES, AMENDING
ARTICLE 2 SYSTEMS DEVELOPMENT FEES OF CHAPTER II, LOCAL
IMPROVEMENTS OF THE SPRINGFIELD CODE; AMENDING SECTIONS 2-11-7
"COLLECTION OF CHARGES, SUBSECTION (2) AND (4) AS DESCRIBED AND
SET FORTH AS FOLLOWS; AND DECLARING AN EMERGENCY.
THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:
section 1: Subsections 2 and 4 of section 2-11-7 "Collection of
Charge" of Article 11 System Development Fees of Chapter II "Local
Improvements of the Springfield Code are hereby amended as
follows:
"(2) If development is commenced or connection
is made to the water system, sanitary sewer
system, or storm sewer system without an
appropriate permit, approval, or deferred payment
agreement, the system development charge is
immediately payable upon the earliest date that a
permit was required."
"(4) The obligation to pay the unpaid system
development charge and interest thereon shall be
secured by property, bond, deposits, letter of
credit, deferred payment agreement, or other
security acceptable to the City Manager or the
Manager's designee."
Section 2: It is hereby found and determined that matters
regarding the System Development Charges are matters affecting the
public health, safety and welfare and that an emergency exists
and that this ordinance shall therefore take effect immediately
upon its passage by the City Council and approval by the Mayor.
ADOPTED by the Common Council of the City of Springfield by
a vote of 6 in favor and 0 against this 17th of
May , 1993.
APPROVED by the Mayor of the City of Springfield this 17th
day of May , 1993.
