ORDINANCE NO. 5691
AN ORDINANCE VACATING THE VEST 30 FEET OF AN ALLEY LOCATED BETVEEN C AND D STREETS
AND 10TH AND 12TH STREETS, PLATTED AS PART OF BRATTAIN'S ADDITION TO SPRINGFIELD, AND
DECLARING AN EMERGENCY.
VHEREAS, the Springfield City Council has declared its intention to Vacate a portion
of an alley platted as part of the Brattain's Addition Subdivision in the City of
Springfield as attached; and
VHEREAS, such Vacation is in the best interest of the City in carrying out its plans
and programs for the general development of the City; and
VHEREAS, lawful notice of the proposed Vacation was published and posted; and
VHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth Street,
on Monday, the 17th day of May, 1993, at the hour of 7:30 p.m., to hear any objections to
the proposed Vacation and ~ persons appeared to object;

Section 1: The Council finds that legal notice of the hearing was lawfully published
and posted; that 0 objections were made at the Vacation hearing held; that public
interest will not oe-1mpaired by the Vacation of the alley and that said alley Vacation
will be to the best interest of the public and increase the benefi t of the property
involved.
Section 2: The following described public right-of-way in the City of Springfield is
~ declared to be Vacated, being generally described below:
Beginning at a point on the South line of "D" Street in Springfield, Lane County,
Oregon, at the Northeast corner of Block 4 of Brattain's Addition to Springfield, as
platted and recorded in Book 9, Page 6, Lane County, Oregon Plat Records, and running
thence south along the East line of said Block 4 a distance of 119.85 feet to the
true point of beginning on the North line of a 14.00 foot wide alley running East and
Vest between "C" and "0" Streets; thence East along the North line of said alley
30.00 feet; thence South 14.00 feet to the South line of said alley; thence Vest
along the South line of said alley 30.00 feet to the aforementioned East line of
Block 4 in said Brattain's Addition to Springfield; thence North along said East line
14.00 feet to the true point of beginning in Springfield, Lane County, Oregon.
Section 3: The findings in the staff report for Jo. No. 93-02-30 are hereby made
part of this Ordinance by reference.
Section 4: It is hereby found and declared that matters pertaining to the Vacation of
this alley are matters affecting the public health, safety and welfare of the Cfty of
Springfield and that this Ordinance shall, ther.efore, take e,ffect immediately upon its
passage by the Council and approval by the Mayor"..,',-

Section 5: The City hereby reserves an easement to locate, continue, repair,
reconstruct, renew, replace, rebuild and enlarge any utilities now located on the property
vacated or which may be necessary to cross such property.
Section 6: It is a further condition of this Vacation that nothing herein contained
shall cause or require the removal of or abandonment of any sewer, water main, gas main,
conduit of any kind, pole or thing used or intended for any public service or any easement
therefore. The right is hereby reserved for the owner of any such utility or thing to
maintain, continue, repair, reconstruct, renew, replace, rebuild and enlarge any and all
such things under existing or future easements.
Section 7: The City Recorder is directed to file certified copies of this Ordinance
with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor.
ADOPTED by the Common Council of the City of Springfield this 17th day of May, 1993,
by a vote of 6 for and ~ against. C
