Waiver Procedure
AN ORDINANCE ADOPTING THE REPORT OF THE CITY ENGINEER FOR THE CONSTRUCTION OF
CONCRETE PAVEMENT, CURB AND GUTTERS, SIDEWALKS, STREET TREE INSTAllATION, AND
STORM DRAINAGE IMPROVEMENTS TO SERVE NORTH 8TH STREET, G STREET TO SPRINGFIELD
HIGH SCHOOL PROPERTY (1-794).
THE SPRINGFIELD CITY COUNCIL DOES ORDAIN AS FOllOWS:

Section 1: At the direction of the Council, the City Engineer filed his
report with the City Recorder on May 17, 1993, regarding the construction of
concrete pavement, curb and gutters, sidewalks, street tree installation, and
storm drainage improvements to serve North 8th Street, G Street to Springfield
High School property (1-794), and said report is hereby adopted.
Section 2: Upon receipt of the above Engineer's Report and upon a
waiver or waivers having been signed by 100% of the property owners to be
assessed and placed on file, waiving public hearing, advertising. for bids,
notice of construction, notice of assessment and waiver of any ~ndall other
irregularities in the proceedings and ratifying and confirming all that may be
done in the premises including City Engineer's charges for administration,
legal fees, engineering costs, superintendence and inspection, advertising,
financing costs, assessment service fee, and interest may be assessed against
said benefited property all consistent with the City Engineer's Report. ~
Section 3: The Council does hereby award the contract for said street
improvement to Gelco Construction Co. for the sum of $30,572.21.
Section 4: Whereas it is necessary that such improvements should be
made at once, the Council declares that an emergency exists and that this
ordinance shall be effective after its passage by the Council and approval by
the Mayor.
Adopted by the Common Council of the City of Springfield this 17th day
of May, 1993, by a vote of 6 for and 0 against.
Approved by the Mayor of the City of Springfield, Oregon, this 17th day
of May, 1993.
