RESOLUTION NO. 96-33 AN RESOLUTION INITIATING ANNEXATION OF CERTAIN- TERRITORY TO THE CITY OF SPRINGFIELD' AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION DELAY THE EFFECTIVE DATE TO JANUARY 3, 2000. WHEREAS, the City Council is aut~orized by ORS 199.490(2)(B) to initiate annexation upon receiving consent in writing from a majority of the ejectors registered in the territory proposed. to be annexed and written consent from owners of more than half the land in the territory proposed to be annexed (Attachment 1), and WHEREAS, the property owners of certain territory signed a consen~ to annex (Attachment 2) and there were no electors registered in the territory, and WHEREAS, sanitary sewer service can be provided in timely manner via extension to individual Jots from the sewer line to be constructed in the rights of way' of North Walnut, Poltava and Canal Streets (Attachments 3) and water service can be provided by the Rainbow Water .District, and WHEREAS, ,the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary, and can be provided immediately with a full range of urban services including police protection via a contract with the City and fire protection by the Rainbow Water District, and WHEREAS, an expedited annexation of the proposed rights of way will proceed the annexation of Phase 1 River Trails Subdivision to allow the streets and sanitary sewer to be constructed to sl3rve the lots in' the delayed effective date annexation area, and ' WHEREAS, a delay of the annexation effective date to January 3, .2000 will ensure that the. improved value of the property is captured in thetax base of the City. NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: , Section 1: The Common Council of the City of Springfield does hereby recommend approval of the annexation of the subject territory to, the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territory being described as follows: Township 17 South, Range 3 West, Section 34-2-3, a portion of Tax Lot 1000; as more particularly described in Attachment 2 of this Resolution.. Section 2: The. Council further requests that the Lane County. Local Government Boundary Commission delay the effective date of the annexation until January3, 2000. ADOPTED by the Common Council of the City of Springfield this 3rdday of September, 1996, by a vote of ~ for and ~ against.
