RESOLUTION
No. 95-58
Acceptance
WHEREAS, the State of Oregon, acting by and through its
Department of Transportation, hereinafter referred to as "StateH, and
the City of Springfield, acting by and through its Elected Officials,
entered into Agreement No. 10,741 on August 9, 1993, concerning the
Fund Exchange associated with the reconstruction of 42nd Street from
Main Street north to railroad tracks in the City of Springfield,
and,
WHEREAS, the City of Springfield requested a time extension of
Fund Exchange Agreement No. 10,741,
and,
WHEREAS, the State has granted the time frame extension and
issued Amendment No.3 to Agreement No. 10,741 which amends Paragraph
6, Section M, page 3 to read as follows:
"This contract shall be in effect beginning on the date State's
representative executes this agreement, until December 31, 1996,
unless otherwise extended or renewed by formal agreement of the
parties.H
NOW THEREFORE BE IT RESOLVED that the Common Council of the City
of Springfield does hereby approve Amendment No. 3 to Fund Exchange
Agreement No. 10,741 extending the original agreement time frame.
Adopted by the Common Council of the City of Springfield, Oregon,
the 5th day of September , 199 5 .

AMENDMENT No. 3
The State of Oregon, acting by and through its Department of Transportation,
hereinafter referred to as "State", and the City of Springfield, acting by and
through its Elected Officials, hereinafter referred to as "Agency", entered into an
agreement on August 9, 1993. Said agreement concerns the Fund Exchange
associated with the reconstruction of 42nd Street from Main Street north to
railroad tracks in said city.

It is now determined by State and Agency that the agreement referenced above,
while remaining in full force and effect, shall be amended by this agreement to
extend the time frame to December 31, 1996.
Paragraph 6, Section M, page 3, which now reads:
This contract shall be for two years, beginning on the date State's
representative executes this agreement, and terminating two calendar
years later, on the same month and day, unless otherwise extended or
renewed by formal agreement of the parties.
Shall be amended to read:
This contract shall be in effect beginning on the date State's
representative executes this agreement, until December 31, 1996, unless
otherwise extended or renewed by formal agreement of the parties.

IN WITNESS WHEREOF, the parties hereto have set their hands and affixed
their seals as of the day and year hereinafter written.
On April 12, 1995, the Oregon Transportation Commission adopted Delegation
Order 2, which became effective May 1, 1995. The Order grants authority to
region managers to approve and execute agreements for work in the current
Statewide Transportation Improvement Program or approved workplari budget.
