'.~-, r , .- " RESOLUTION NO. 95-3 -'" A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SPRING- FIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION DELAY THE EFFECTIVE DATE TO JULY 1, 1998 AND APPROVE EXTRA TERRITORI- AL SEWER AND WATER EXTENSIONS. WHEREAS, the City Council is authorized by ORS 199.490(2)(a)(B) to initiate annexation upon receiving consent in writing from a majority of the electors registered' in the territory proposed to be annexed and written consent from owners of more than half the land in the territory proposed to be annexed, and WHEREAS, the property owner of certain territory signed a petition for annexation and there are no electors registered in the territory, and WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary, abuts the City limits of Springfield, and can be provided immediately with a full range of urban services, and WHEREAS, a delay of the annexation effective date to July 1, 1998 will ensure that the improved value of the property is captured in the tax base of the City, and WHEREAS, the extraterritorial extension of sanitary sewer and water service to the territory is necessary to allow the property to develop prior to the effective date of the annexation, and is co'nsistent with the policies of the Metro Plan and the City. NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: Section 1: The Common Council of the City of Springfield does hereby recommend approval of the annexation of the subject territory to the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territory being described as Township 17 South, Range 3 , West, Section 15, Tax Lot 1116 (portion); as more particularly described in the attached legal description. Section 2: The Council further requests that the lane County Local Government Boundary Commission delay the effective date of the annexation until July 1, 1998. Section 3: The Council further requests approval of extra-territorial sewer and water extensions to the territory described in Section 1 above. ADOPTED by the Common Council of the City of Springfield this 6th day of February, 1995, by a vote of 6 for and 0 against.
