Dear Mr. Schweitzer:
This letter is to confirm the status of the zoning for the subject property.
The property is zoned Low Density Residential,
According to City records there are 5 residential units located on this
property. The zoning permits only one' unit per Low Density Residential tax
lot. Four of the units located on this property have been determined to
be Non-Conforming Uses. These uses may continue to exist and be rented in
conformance with Article 5 of the Springfield Development Code.
Basically, routine maintenance can be performed on the buildings provided
that they do not receive structural damage exceeding 50 percent of the
replacement cost, as determined by the Building Official. If the structures
receive damage exceeding 50% of the replacement value they cannot be replaced,
Additionally, the units must be maintained and occupied. If the units are
not occupied for 90 days or longer they cannot be re-occupied.
I have enclosed a copy of Article 5 for your information. Also enclosed
are copies of the Apartment License issued for the past few years.
