Subject: NOTICE TO VACATE BUILDING AND TO COMPLY WITH SPRINGFIELD BUILDING

Dear Mr. Bryant:
The City of Springfield Building Safety Division recently inspected the
structure(s) located at the subject address, Lane County Tax Assessor's Map it
17 02 34 4 4, Tax Lot it01iOO, and found it to be, for reasons specified below,
a substandard and unsafe building as described in the Springfield Housing Code.
Lane County Taxation and Assessment records reveal that you are the owner of
this property.
Section 203 of the Springfield Building Code Administrative Code classifies
structures which are structurally inadequate or are dangerous to human life as
unsafe. Section 1001 of the Housing Code specifies conditions which constitute
a substandard building. The following items include but are not limited to
conditions existing at the structure, classifying it as a substandard and
unsafe building:
Structural Hazards
The floor system in the attached structures south of the main dwelIlng is
either deteriorated or missing. Evidence of extensive deterioration and
delapidation is also evident in the walls and roofs of the attached
structures to the point that structural failure is possible. Sections
1001 (c), (2), (4), and (5) of the City of Springfield Housing Code
(S.H.C.) cite these conditions as structural hazards.
Hazardous Wiring
Open splices, bare live conductors, and open-face switches occur throug-
hout the dwelIlng. Switch and outlet covers are not installed in many
locations. Electrical boxes are not installed flush with the wall surface
creating a potential fire hazard. Electric cook top wiring shows evidence
of open splices with-in the adjacent wall. The electrical service
equipment is installed in a locked room which is inaccesible to the tenant
and cannot be inspected. Several switch and outlet boxes are not ade-
quately secured to adjacent framing. The presence of slanding water in
the attached south section of the dwelling causes exposed wiring in this

area to be potentially hazardous. Section 1001 (e) of S.H.C. considers
these conditions to be hazardous wiring.
Hazardous Plumbing
Waste water from the dishwasher and kitchen sink discharge on the ground
below the south sections of the dwelling. Raw sewage is evident at the
sewer cleanout in the south yard, indicating possible sewer line blockage
or improper installation. Section 1001 (f) of S.H.C. considers these
conditions to be hazardous plumbing.
Hazardous Mechanical Equipment
The existing wood stove in the dining area is installed without adequate
clearances or protection from combustible materials. The wood stove is
vented by single-wall stove pipe in the attic which creates a potential
fire hazard. The existing wood stove shows signs of metal fatigue from
over-firing and must be repaired or replaced. These cqnditions are in
violation of section 1001 (f) S.H.C.
Section 204(b) of the Administrative Code provides procedures where the
Building Official may require vacation of the premises when cited deficiencies
represent an immediate hazard to life, limb, property or safety of the public
or its occupants. Notice is hereby served that the premises are being posted
for vacation on February 3, 1986, due to the potential hazard to the occupants
resulting from the above-cited conditions.
Section 202 of the Housing Code requires that structures classified as substan-
dard as described above are public nuisances and must either be repaired or
demolished. Therefore, this is your notice that you must secure permits to
either repair the structure (Section 104 of the Springfield Building Safety
Codes Adminisrative Code requires that it be rebuilt to comply with all
provisions of th Springfield Structural Specialty Code and Fire and Life Safety
Code) or demolish it. If the building is to be rebuilt, permits must be
purchased by February 3, 1986, and work must commence by March 3, 1986.
Construction must be completed by May 3, 1986. If the building is to be
demolished, a permit must be obtained by February 3, 1986. Demolition work
must commence by March 3, 1986, and must be completed by April 3, 1986.
Completion means that the structure and property must be inspected and approved
by the appropriate Fepresentatives of the Building Safety Division. The sewer
must be capped at the property line or the septic tank must be pumped and
filled by a person holding a sewage disposal service license as provided for in
Chapter 340, Division 7 of the Oregon Administrative Rules. Permits for
reconstruction or demolition can be obtained at the Springfield Planning and
Development Department, 225 North 5th Street.
If you do not take corrective action within the time frame outlined above, the
City will seek compliance with the Building Safety Codes through legal recourse
which may include Municipal Court proceedings or the City may proceed to
eliminate the hazard and charge the costs thereof against the property or its
owners.
Any person having any record title or legal interest in the building may appeal

from this notice and order to the Building Board of Appeals, provided that the
appeal is made in writing and filed with the Building Official within thirty
(30) days from the date of service of this notice and order. Failure to appeal
will constitute a waiver of all rights to an administrative hearing and
determination in the matter.
