City of Springfield Regular Council Meeting MINUTES OF THE REGULAR MEETING OF THE SPRINGFIELD CITY COUNCIL HELD MONDAY, OCTOBER 18, 1993 The city of Springfield Council met in Regular Session in the Springfield City Council Chamber, 225 Fifth Street, Springfield, Oregon, on Monday, October 18, 1993, at 7:10 p.m., with Council President Jesse Maine presiding. ATTENDANCE Present were Council President Jesse Maine, Councilors Beyer, Shaver, Walters, Burge and Schanz. Mayor Morrisette was absent (excused). Also present were City Manager Michael Kelly, Assistant City Manager Gino Grimaldi, City Attorney Joe Leahy, City Recorder Eileen Stein, and members of the staff. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilor Maine. INVOCATION The invocation was given by Rev. Richard Glidden, St. John Divine. CONSENT CALENDAR IT WAS MOVED BY COUNCILOR SHAVER, WITH A SECOND BY COUNCILOR BEYER, TO ADOPT THE CONSENT CALENDAR. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. 1. Claims a. Approve the September, 1993 Monthly Financial Reports. c. Endorsement of OLCC Liquor License for Breaux's Bar & Grill, 1836 S. A Street. BUSINESS FROM THE AUDIENCE 1. W. G. Willie Combs, 344 Scotts Glen Drive, explained he was in favor of seeing the city of Springfield separate from the city of Eugene and Lane County in relation to the Metro Plan process. He explained he was concerned about expense of becoming independent. He felt the city of Eugene would do everything possible to increase the cost of becoming independent. He urged the Council to investigate if the cost could be lower than $600,000 for the process. 2. William Eikenberry, 2625 E Street, thanked the city staff and Council for a quick response to questions he brought to Council's attention regarding a personal matter. CORRESPONDENCE AND PETITIONS 1. Correspondence to Linda Weston, Convention and Visitors Association of Lane County, from Ralf Walters, $TRAVEL MONEY$, PO Box 532, Expressing Concern Over the Mahoney's, Antique Peddlers, Targeting His Business Through Hateful Letter Writing Campaigns to $TRAVEL MONEY$ Advertisers. IT WAS MOVED BY COUNCILOR SHAVER, WITH A SECOND BY COUNCILOR BURGE, TO ACCEPT AND FILE THE CORRESPONDENCE. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. Councilor Walters explained that he wanted Council to be aware of the personal and financial attacks made against him. He felt many personal attacks were politically motivated. He explained that his family has suffered financially because of the attacks and that he has also received death threats. He explained that he did not want to raise issues which would create additional publicity and further hurt him but felt it was time to make the Council aware of these activities. He reported that he was served a subpoena this evening. He explained that the subpoena was related to a legal claim involving Mr. George Wickizer vs. the Oregon Citizen Alliance (OCA). Councilor Walters said he was not a member of the OCA and did not understand why he was being subpoenaed. He explained that he did not expect any action from the Council but wanted Council to be aware of the situation. He did request that the Council appoint City Attorney Joe Leahy to represent him and that Mr. Leahy accompany Councilor Walters to court on Tuesday, October 26. Councilor Schanz explained that he was a member of the OCA and was the Council liaison for the Human Rights Commission but was not being attacked . . . City Attorney Joe Leahy recommended that Council adjourn into executive session to further discuss this issue. 2. Councilor Greg Shaver read into the record a letter received from Art and Rose Brown, 1135 6th Street. The Brown's expressed concern that the Library had no age restrictions for video check-outs and that their 13 year old son checked out an "R" rated video. The Brown's requested information regarding the process to implement a policy for age restrictions. Councilor Maine also received a copy of the letter. IT WAS MOVED BY COUNCILOR SHAVER, WITH A SECOND BY COUNCILOR BURGE, TO ACCEPT AND FILE THE CORRESPONDENCE. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. Council referred this issue to staff and requested that a procedure be developed for checking out videos from the Library if a policy is not not already in place. City Manager Mike Kelly explained that a response would be provided to Council through the Communication Packet regarding city policy. BUSINESS FROM THE CITY COUNCIL 1. Other Business a. Councilor Shaver discussed the monthly financial reports. He did not feel the report provided adequate information regarding expenditures for projects. City Manager Mike Kelly explained that the department directors and supervisors monitored the budget to be sure departments were on target for fiscal year spending. He explained that the monthly report shows an asterisk next to any line item being expended faster than the budget year is occurring. He also stated that if Council had interest in receiving more in-depth documents regarding progress to date versus expenditures to date, this could be further researched. He explained that there has been discussion regarding the possibility of conducting meetings more frequently between the Council and Budget Committee lay members. The additional meetings may provide a more current status report on budget activity and to review goals being met. Councilor Burge was comfortable with leaving the responsibility of overviewing the different department budgets to the discretion of the City Manager. Council further discussed this issue in detail and discussed quarterly reports. It was agreed that a quarterly report showing progress to-date compared with expenditures to-date would be more meaningful. b. Councilor Burge proposed that the city sell confiscated firearms to help fund Neighborhood Watch programs, He explained that currently these confiscated firearms are destroyed. Councilors Beyer and Maine . . . City Council Regular Session Meeting Minutes - 10/18/93 Page 4 expressed opposition to this idea. City Manager Mike Kelly responded that staff could prepare a report regarding the number of firearms confiscated and the value of those firearms to determine what the proceeds would be. 3. Committee Reports. a. Councilor Shaver reported on the recent McKenzie Watershed Council meeting. The Council recently adopted a charter and would be working on ground rules. He explained that the McKenzie Watershed Council would function on a consensus basis for decision making. BUSINESS FROM THE CITY MANAGER 1. City Manager Mike Kelly introduced Bill DeForrest, the new Police Chief and Bob Russell, the new City Librarian. BUSINESS FROM THE CITY ATTORNEY None.
