This action led to Resolution NO OS-36 and was adopted by Council and signed by the Mayor on July 21, 200S. Since that time a Development Issues Meeting (DIM) was held on Dec. ISth, . 200S (ZON200S-00041) where City Staff initiated the annexation process. This action was followed by a pre-submittal (pRE2009-00004) meeting on Feb. 13th, 2009 where the application was reviewed for completeness. City Staff has addressed the items discovered in that review and is now submitting an application for annexation. Accompanying this memo is the annexation application packet for your review and signature. Your signature is required as the duly authorized representative of the City of Springfield. The application will be submitted and reviewed by City Staff for official comment. As the process unfolds, I will keep you informed of our progress and any important dates or issues that arise. Written Narrative: See below The annexation of these various parcels is being initiated to bring property owned by Lane County and the City of Springfield into the jurisdiction of the City. It is currently under the jurisdiCtion of Lane County. Addressing specific criteril!- as required by code SDC5.7-125(B) (13) and (14): A. The affected territory is within the current UGB and is contiguous to the city limits B. The proposed annexation is in fact consistent with applicable policies in the Metro Plan. and any refinement districts. ' C, All urban services have been constructed and the right of way has been fully improved to meet the requirement of providing minimum levels of key urban services. D. There are no immediate fiscal impacts to the City. Long term maintenance obligations do exist. An annexation agreement is not required. This is a council initiated action. Tne City bas no recent history of unilaternlannexations and there are no plans for unilaterally annexing any offuat territory, but State law gives the CitY the authority to do so. With the exception of public staff time dedicated to the annexation _process, there are no other signiDcant financial impacts associated with the initiation by Council - Resolution. -If initiated, the proposed annexation ordinance would be scheduled- to come before the City COUDcil at a public heariI!g on or about October 6, 2008. BRiID< ll'iG MEMORANDUM ISSUE The City Manager requests City Council authority to sign the application for annexation for. lands associated with the Martin Luther King, Jr. Parkway, as a part of completing the new arterial link and assuming responsibility from Lane County. BACKGROUND In February 2003, the City of Springfield and Lane County executed an Intergovernmental Agreement (IGA) for the use of Lane County Community Development koad Improvement Assistance Program (CAP) funds to design and conStruct the Martin Lulher King,. Jr. Parkway. In this agreement, it is stated that the project roadways Will be City streets and that the City 'il'Iill be responsible for maintenance. In order for the City to assume maintenance responsibility the City and County agreed the .streets would become City right-of-way and be annexed into the City limits. Much of the MLK Jr. Parkway right of 'way is within City limits, through annexations associated with the PeaceHealth RiverBend project; however, over half still needs annexation. In addition, there are segments of Pioneer Parkway East and West, Hayden Bridge Way at the roundabout and a small pornon of the Beltline/Game Farm Road intersection that the City Engineer and County Engineer have .agreed should also be transferred, for a total annexation of 11.34 acres. ' DISCUSSION Properties proposed for annexation are limited to street right-of-way and City-owned lands only. There are no privately owned lands proposed for annexation with thls action. Annexation of these lands may create islands of un-annexed County lands within City limits. S~ law gives the City the authority to forcibly annex lands in islilnd within the city limits without the request or consent of the affected property owners. The City of Springfield has ~ plans at this .time to forcibly annex these island areas, and has not exercised the authority to do so in the recent past. It is likely the creation of these islands may cause some concern , . among !,LV>'''L~i owners within the islands. The letter would also confirm for these property owners that this annexation action is strictly to create ownership and maintenance consistency with the new City streets.
