A council briefing memorandum was prepared July 15, 200S asking the city council to authorize
the City Manager to sign an annexation application for the Martin Luther King Jr. Parkway to
become city right of way and the City of Springfield to provide maintenance to those streets.
This action led to Resolution NO OS-36 and was adopted by Council and signed by the Mayor on
July 21, 200S. Since that time a Development Issues Meeting (DIM) was held on Dec. ISth, .
200S (ZON200S-00041) where City Staff initiated the annexation process. This action was
followed by a pre-submittal (pRE2009-00004) meeting on Feb. 13th, 2009 where the application
was reviewed for completeness. City Staff has addressed the items discovered in that review and
is now submitting an application for annexation.
Accompanying this memo is the annexation application packet for your review and signature.
Your signature is required as the duly authorized representative of the City of Springfield. The
application will be submitted and reviewed by City Staff for official comment.
As the process unfolds, I will keep you informed of our progress and any important dates or
issues that arise.

The annexation of these various parcels is being initiated to bring property owned by Lane
County and the City of Springfield into the jurisdiction of the City. It is currently under the
jurisdiCtion of Lane County. Addressing specific criteril!- as required by code SDC5.7-125(B)
(13) and (14):
A. The affected territory is within the current UGB and is contiguous to the city limits
B. The proposed annexation is in fact consistent with applicable policies in the Metro Plan.
and any refinement districts. '
C, All urban services have been constructed and the right of way has been fully improved to
meet the requirement of providing minimum levels of key urban services.
D. There are no immediate fiscal impacts to the City. Long term maintenance obligations do
exist. An annexation agreement is not required. This is a council initiated action.

Annexation of lands associated with the Martin Luther King, Jr. Parkway, is one of
the final steps in completing the new arterial link and assuming responsibility from
Lane County: This includes all future maintenance and legal jurisdiction within the
rights ofway.

Annexation transfers legal jurisdiction within the rights of way and pUblic property
to the City of Springfield and allows the City.of Springfield Police Deparbnent to
investigate and track -accident reports. Also, any citations issued would be processed
. through Municipal Court rather than Lane County Com
The annexation of the rights-of-way for this project may create islands of un-
annexed County land wi1hin the City limits. Tne City bas no recent history of
unilaternlannexations and there are no plans for unilaterally annexing any offuat
territory, but State law gives the CitY the authority to do so.
With the exception of public staff time dedicated to the annexation _process, there are
no other signiDcant financial impacts associated with the initiation by Council -
Resolution. -If initiated, the proposed annexation ordinance would be scheduled- to
come before the City COUDcil at a public heariI!g on or about October 6, 2008. A
second. reading and adoption of a proposed ordinance annexing the subject area
could occur on or about NOvember 3, 2008. .

The City Manager requests City Council authority to sign the application for annexation for.
lands associated with the Martin Luther King, Jr. Parkway, as a part of completing the new
arterial link and assuming responsibility from Lane County.
BACKGROUND
In February 2003, the City of Springfield and Lane County executed an Intergovernmental
Agreement (IGA) for the use of Lane County Community Development koad Improvement
Assistance Program (CAP) funds to design and conStruct the Martin Lulher King,. Jr.
Parkway. In this agreement, it is stated that the project roadways Will be City streets and that
the City 'il'Iill be responsible for maintenance. In order for the City to assume maintenance
responsibility the City and County agreed the .streets would become City right-of-way and be
annexed into the City limits. Much of the MLK Jr. Parkway right of 'way is within City limits,
through annexations associated with the PeaceHealth RiverBend project; however, over half
still needs annexation. In addition, there are segments of Pioneer Parkway East and West,
Hayden Bridge Way at the roundabout and a small pornon of the Beltline/Game Farm Road
intersection that the City Engineer and County Engineer have .agreed should also be
transferred, for a total annexation of 11.34 acres. '
DISCUSSION
Properties proposed for annexation are limited to street right-of-way and City-owned lands
only. There are no privately owned lands proposed for annexation with thls action.
Annexation of these lands may create islands of un-annexed County lands within City limits.
S~ law gives the City the authority to forcibly annex lands in islilnd within the city limits
without the request or consent of the affected property owners. The City of Springfield has ~
plans at this .time to forcibly annex these island areas, and has not exercised the authority to
do so in the recent past. It is likely the creation of these islands may cause some concern

owners within the new islands to explain the City's intention not to annex these. lands without
a reqiIest from property owners, or to comply with statutory requirements concerning
development of land or providing public wastewater service in the event of fail,ed septic
systems. The letter would also confirm for these property owners that this annexation action
is strictly to create ownership and maintenance consistency with the new City streets. Figure
I shows the islands that will be created by the proposed annexation.

WHEREAS, the City Council is authorized by SeC\ion 5.7-125 of the Springfield Development
Code to initiate annexation of contiguous property to the City Limits of Springfield, and
WHEREAS, the property to be annexed is publicly owned property and rights of way of the State
of Oregon, and .
WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary,
is contiguous to the City of Springfield and can be provided with a full range of key urban services
including sanitary sewer, water, storm drainage, police and fire protection, electrical service, land
,use contr<?ls, street lights.and paved streets, recreational facilities arid library.
WHEREAS, annexation procedures shall be initiated and followed in accordance with the public
notice and hearing process, criteria of approval arid ordinance adoption procedures contained in
Springfield Developmefrt Code Section 5.7- Annexations... .

THIS MATTER now coming before the Board of. County Commissioners of Lane County, and the
Board deeming it to be in the best interest of Lane County and the .pubfic to dedicate a porDon of that
certain tract of land conveyed to Lane County by warranty deed recorded November 5, 1973 on Reel
663, Recorder's Reception Number 7350074, Lane County, Oregon Deed Records; and
WHEREAS, the Lane County Board of Commissioners have been provided a good and sufficient
deed forever dedicating a portion of the land for public road purposes and expressly as a portion of
. County Road Number 2151 (Pioneer Parkway East, originally established as Third Street), and the
Board of County Commissioners of Lane County deeming It proper, as a convenience for property
owners in the area and as a benefit to the general public, to accept said deed for a public road
easement; and
WHEREAS, the Board of County Commissioners of Lane County also deem it to be in the best
interest of Lane County and the pubic to authorize Lane County Administrator's consent to the
annexation of property described in the petition for annexation attached hereto and made a part hereof
by this Order; and
NOW, THEREFORE, IT IS HEREBY ORDERED that the said deed shall be and is hereby
accepted by the Board of County Commissioners of Lane County as a public road easement; and
IT IS FURTHER ORDERED that the right of way described in said deed is expressly accepted as
a portion of County Road Number 2151 (Pioneer Parkway East, originally established as Third Street) by
this Order, and
IT IS FURTHER ORDERED that authorization is hereby given to the County Administrator to sign
said petition for annexation on behalf of Lane County; and .
IT IS FURTHER ORDERED that this Order shall be entered in the records of the Board of
County Commissioners' Joumal of Administration and in the corresponding road records files of the
County Surveyor's Office; and
IT IS FURTHER ORDERED that the deed and the petition for annexation be recorded In the

LANE COUNTY, a political subdivision of the State of Oregon, GRANTOR, grants and dedicates to
the PUBLIC for public and County Road purposes, and expressly as a portion of County Road
Number 2151 (Pioneer Parkway East, originally established as Third Street), a public road easement
on and over the following described property:
A parcel of land lying In the Southeast one-quarter (SE 1/4) of Section 22 and the' Northeast one-
quarter(NE~) of Section. 27, Township 17 South, Range 3 We~ of the WilIamette Meridian, Lane
County, Oregon, and being a portion of that tract of land conveyed to LANE COUNTY, a political
subdivision of the state of Oregon, by that certain deed recorded November 5, 1973, on Reel 663,
Recorder's Reception Number 7350074, LANE COUNTY OREGON DEED RECORDS, said parcel

'Beginning at a point which is the Intersection of the Easterly right of way of the

Summary and explanation of edits required to the MLK Annexation
Description that was submitted to City Council on July 21, 2008 under
the following proposed resolution: A RESOLUTION INITIATING
ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF
SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE
SPRINGFIELD DEVELOPMENT CODE.

Tract 1:
This description was edited because first, the original description contained errors,
second, adjacent city owned tax lots are to be split so parts of the taxlots are. in the street
right of way and the remainders can be sold off by the City (or utilized otherwise, not yet
determined), and third the original description included land North ofthe North end of
the MLK sound-walled corridor that was vacated railroad right of way, and with a recent
sale the land is not privately owned. Detailed changes to the description are:
. Lines 5) and 6) added to replace line 4 from the original description, to correct the
description to match the surveyed right of way per Lane County's MLK ROW
survey map filed March 2007 at County Survey File No. 40328.
. Lines 34) through 39) added to replace lines 6 through II from the original
description, to reflect the recent configuration change of City of Springfield
owned tax lots 460 I and 5102, portions of which are to be dedicated as street right
of way.
. Lines 48) and 49) were added to replace line 16 and all described liries up to "And
also including:" from the original description. The original description continued
off the street right of way ofMLK Jr. Parkway and onto the vacated railroad right
of way. Said railroad right of way is now part of private land, so it is omitted
from the description.
Tract 2:
This description includes the land that was described at the end of the original
description, from the line "And also including:" through the end. The new description is
more detailed than the original and is formatted to be more likely to be approved by the
State for annexation. It includes the same area of land as the original description did.
Tract 3:
This description was added to clean up the West edge of Game Farm Road North, a strip
of road right of way 10 feet wide which has never been annexed into the City, but has
been improved during the recent improvements.
