specifically for the requirements of the Generic Remedy for Simple Risk-BaSe4 Cleanups, and that
no further actionisrequir,ed,atthistime. This determination is a result o(QUJ evaluation and
judgment based on'theiegUlatioilsandfacts as we now understand them"inc1u~jng the following.

samples were also analyzed for BTEX compoundS. No BTEX compounds :~ere' detected. A

4. Several test pits were excavated in April 1990 to determine the extent of the diesel
contamination. Soil samples were Collected from the test pitS and analyzed fo~ TPH.' Petroleum -
, hydrocarbons were detected in three oithe test pits at cOncentration ranging Irom 2,020 mg/kg
to 2,310 mg/kg. :1

5. Seyen additional test pits were exCavated on April 15, 1998. Soll samples w.~re collected, from
five of the test pits and, analyzed for diesel by DEQ method NW'l,'PH-Dx. Diesel
conCentrations ranged between 410 mg/kg and 4,700 mg/kg. Additional analyses for PAH ,

compourids were completed on thr~, samples. Several Cljfcinogenic P AH colfPounds exceeded "
generic risk-based concentrations. I:

6. Six borings were drilled December 15, 1999, to further assess the contamination. Three of the
borings were completed ~monitoring wellS. Soil samples were collected I from four of the
borings ,and analyzed for gasoline or diesel as appropriate. Diesel was detecttfct in boring B~3 at
a concentration of 1,120 mg/kg.' Lower levels of kerosene and lube oil were !also detected. No
gasoline was deteCted. Groundwater samples were collected from boringsji B-2 and B-3 and
analyzed for BTEX and P AH compounds. All detected, compounds were below the inost
stringent generic risk-based concentrations. ' ,', '

7. GroUndwater samples were colleCted from the three monitoring wells on January 25, 2000, and '
analyzed for BTEXand PAH compomids. No BTEX or PAH compounds w~re detected:, '
8. Approximately 745 tons of petroleumcontaminatCd soil w.is excavated from; the southern half
of the property in August' 2000., The contaminated soil was traIisported to and, disposed at '
Coffin Butte Landfill in Corvallis, Oregon. ' ' 1 , ' , '
9. Twelve,confrrmation soil samples were collected from limits of the excavation and analyzed for
,diesel. Diesel and/or lube oil was detected in 5 of the samples. The maximhm concentrations

were detected in sample NIC-OO-05 q.t 5,150 mg/kg diesel and 5,240 mg/kg lube oil. Basedon
sampling results and observationS, 'Omnicon Environmental MlinagemJnt estimates the
rpmo;n;ng contaminated soil to be approximately 30 cubic yards. Additionlu excavation was
not practicable due to on-site, structures and utilities. I'
10. The Department requested an additional soil sample be collected in thevic*ty of worse case
sample NIC-OO-05 and analyzed for BTEX and PAH compounds. A boringliwas advanced on
January 5, 2001, and soil sample collected. Detected contJlminJlnt concentrationS were below
